2'he Seal Beach Planning Commission meets in session every first and third Wednesday of each
month at 7:30 p.m. If you wish to address the Commission on any particular public hearing
item, the Chairman will call for public testimony first for those in favor of the project,
and second, for those who are not in favor. When you see that the speaker's position in the
center of the room is unoccupied, step up to the microphone and when recognized by the
Chairman, speak directly into the microphone by first stating your name and address clearly
and distinctly for the records. State your business as clearly and succinctly as possible
and then wait a moment to see if the Commissioners have any questions in regard to your
comments or questions. If there are no other questions or comments, return to your seat
so that the next 'person may address the Commission.
If you wish to address the Commission on matters other than public hearings, the agenda
provides for that time when the Chairman asks for comments from the public. Address the
Commission in the same manner as stated for public hearings, always stating your name and
address first.

PLANNING COMMISSION MEETING OF
NOVEMBER 19. 1986
The Seal Beach Planning Commission met in regular session on
Wednesday. November 19. 1986 at 7:35 p.m. Commissioner Suggs
lead the Salute to the Flag.
ROLL CALL

REPORT FROM SECRETARY
Mr. Knight indicated that each of the Commissioners had received
a memo regarding background on urgency disaster clause. He
stated staff will be scheduling a public hearing for this matter
on December 3. 1986. This resulted from a request from the Old
Town Residents Homeowners Association which approached the
Council in 9ctober to have the City study the disaster clause as
it currently exists in the zoning ordinance and also look at
adopting an interim ordinance that would allow them to rebuild
their units as they exist if destroyed by flooding during the
winter months. The City attorney has prepared a draft ordinance
reflecting that which would go into effect. if adopted. from
November 10. 1986 to July I. 1987. The Planning Commission would
hold a public hearing on December 3rd to provide a report for
Council meeting on December 8th.

reflects Planning Commission denial of Variance 15-86 on November

PUBLIC HEARING - CONDITIONAL USE PERMIT 2-86 - 99 MARINA DRIVE -
CHEVRON USA
.
Mr. Knight indicated this CUP 2-86 was a request from Chevron USA
to authorize modifications to an existing oil extraction facility
in order to upgrade and modernize their outmoded equipment. This
was last heard on August 4. 1986 when the Planning Commission
rejected the proposed Negative Declaration and ordered the
preparation of an environmental impact report. Since that date,
no further action has taken place by Chevron to start the
environmental process. CEQA guidelines require the City to
complete the environmental process within a one year period.
This particular project should have been completed by December
1986. Staff is recommended denial of CUP 2-86 without prejudice

which allows the applicant 'to restart the project where it left
off and not completely reinvent the entire project. This denial
without prejudice can be accomplished by adoption of Resolution
#1409 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF

SEAL BEACH, DENYING WITHOUT PREJUDICE CONDITIONAL USE PERMIT 2-

Chairman Jessner declared the public hearing open. Patricia
Kenner, 311 Spinnaker Way, stated she felt an environmental
impact report should be filed as this is a project that could
have a strong impact on the neighborhood, especially the park.
As no others spoke in favor nor in opposition to this matter,
Chairman Jessner closed the public hearing.
Commissioner Sharp moves to adopt Resolution #1409; Suggs
seconds.

PUBLIC HEARING - CONDITIONAL USE PERMIT 18-86 - 231 14TH ST. -
BURNS
Mr. Knight indicated there was no action needed at this time for
CUP 18-86. The applicants have opted to bring the property into
full conformance.
SCH~DULED MATTERS - PLAN REVIEW 25-86 - 1215-1/2 SEAL WAY
Mr. Knight indicated this Plan Review is submitted by Joe Ribal
who is asking for a height deviation of 6 ft. to an addition of a
covered stairway and atrium to a nonconforming duplex. ZTA 1-84
provides for these minor height deviations. Staff followed
procedure involved with this and owners within a 300 foot radius
have been notified. Staff was able to make the 3 findings for
approving this plan review as indicated in staff report. This
was brought primarily to the Commission due to 2 concerns, stated
Mr. Knight: 1) The covered stairway, referred to as doghouse is
usually permitted by right under the code. The nonconformity of
the site requires Commission approval for minor structural
addition. The second concern was the size of the doghouse and
atrium. These areas measure 132 sq. ft. It was felt it was
appropriate to bring to the Commission and point these concerns
out. Staff is recommended approval with the condition the "the
4"'6" by 6'" opening in the floor of the proposed doghouse shall
remain as indicated in the approved plans so as to prevent the
structure from providing habitable area. Any changes to this
design shall be subject to'Planning Commission review and
approval."

Commissioner Covington suggested the addition of "any subsequent
changes" be added to t.he condition or as a covenant to the title.
Staff was primarily concerned that the atrium could be converted
to habitable space in the future.

Mr. Joe Ribal, 1215-1/2 Seal Way, made himself available for
questions. He stated the project really is a project to enhance
the appearance of the building and within the framework of what
is possible under ZTA 2-84. The concept of the atrium is
important to the plan and Mr. Ribal hoped that it would be
approved. Mr. Ribal indicated he agreed with the condition as
noted in the staff report.
The Commission discussed the design concept in full, the possibly
of heat loss, similar designs on other homes in Old Town.
Commissioner Sharp moved to grant Plan Review 2-86, with the
amended condition to include "any subsequent changes as suggested
by Commissioner Covington; Covington seconds.
