California -- 'l'he Seal Beach Planning Commission meets in session every first and third Wednesday of each month at 7:30 p.m. If you wish to address the Commission on any particular public hearing item, the Chairman will call for public testimony first for those in favor of the project, and second, for those who are not in favor. When you see that the speaker's position in the center of the room is unoccupied, step up to the microphone and when recognized by the Chairman, speak directly into the microphone by first stating your name and address clearly and distinctly for the records. State your business as clearly and succinctly as possible and then wait a moment to see if the COmmissioners have any questions in regard to your comments or questions. If there are no other questions or comments, return to your seat so that the next person may address the Commission. If you wish to address the Commission on matters other than public hearings, the agenda provides for that time when the Chairman asks for comments from the public. Seal Beach Planning Commission Meeting of June 17, 1987 The Seal Beach Planning Commission Wednesday, June 17, 1987 at 7:30 p.m. Salute to the Flag. ROLL CALL Present: met in regular session on Chairman Jessner lead the Chairman Jessner Commissioners Covington, Sharp, Suggs Absent: Commissioner Rullo Also Present: Edward Knight Director of Development Services Chairman Jessner stated that Commissi~ner Rullo had requested his absence from tonight's meeting be excused due to the fact that he was ill. Mr. Covington moves to excuse Mr. Rullo's absence. Mr. Sharp seconds. AYES: NOES: ABSENT: Covington, Jessner, Sharp, Suggs None Rullo Motion Carried CONSENT CALENDAR Those items included in the consent calendar were: A) Minutes of May 20, 1987 Planning Commission meeting and B) Resolution Number 1463, Variance 5-87, 350 Ocean Avenue. Commissioner Sharp moves to approve consent calendar as presented. Commissioner Covington seconds. AYES: NOES: ABSENT: Covington, Jessner, Sharp, Suggs None Rullo 'Motion Carried PUBLIC HEARING - A. CONDITIONAL USE PERMIT 6-87, A-112 SURFSIDE AVENUE - DEAN RASMUSSEN Chairman Jessner stated this matter was a request to permit the construction of a 17' x 23' storage room under the existing deck and living room of a nonconforming single family residence for storage of recreational equipment. Mr. Knight reported that the property is nonconforming due to a substandard front yard setback and inadequate garage width. Mr. Knight noted that Section 28- 2407 of the Municipal Code would permit a 411 square foot addition subject to a consent calendar plan review, but the zoning regulations specific to Surfside Colony, District III, require a conditional use permit for alterations to nonconforming buildings. Staff examined the requested addition to A-112 . Planning Commission Minutes June 17, 1987 Page 2 Surfside for compliance with the three conditions specific to Planning District III, and for compatibility with the surrounding properties and land uses as follows: 1. No bedrooms or other livin~ quarters are being added. The proposed addition woul be used as a storage area. The only rooms beinQ added are bathrooms, storage closets or enlargements of eXlsting rooms. As noted previously, the new room proposed is a storage room. 2. . At least one adequate parking space is provided. The subject property contains a garage measuring approximately 25' x 15' on the interior. These dimensions are more than adequate for a single parking space. Mr. Knight presented two letters to the Commission, one letter from Surfs ide Colony and another from a Surfside resident. Both letters indicated opposition to this proposal in regard to permitting the encroachment of a room under the deck area, as the deck is on leased property owned by Surfside Colony. Staff verified the lot size and the location of the storage room and found the storage area located in the property, and no portion of the room would encroach into the Surfside Colony leased area. Based upon this finding, staff recommends approval of Conditional Use Permit 6-87 subject to the two conditions noted in the staff report. Discussion followed in regard to the two conditions recommended by staff and the proposed addition. 3. Chairman Jessner declared the public hearing open. As no members of the audience spoke either in favor of nor in opposition to this item, Chairman Jessner closed the public hearing. Mr. Covington expressed his concern that this storage room not be converted in the future to living area. Mr. Knight noted the City is requiring that an item be recorded on the title of the property which would indicate for this owner and future owners that this area is only to be utilized for storage purposes. Mr. Sharp and Mr. Jessner were concerned with the number of windows and electrical outlets shown on the plans for the addition. Mr. Knight stated due to the fact that the applicant was not present, he was unable to ask the purpose for the number of windows and outlets. Commissioner Covington recommended continuation of this item to the next Planning Commission meeting so that the applicant may be present. Mr. Knight noted the windows were a requirement of the Title 24 Energy Code whether or not the area . was habitable. He also noted there was no plumbing, heating or . . . ORAL COMMUNICATIONS There were no oral communications from the audience at this time. STAFF CONCERNS Mr. Knight noted that Mr. and Mrs. Nair, 340 Ocean Avenue were filing an appeal to the City Council for Variance 5-87 and that Mr. and Mrs. Shaddox, 222 7th Street, were also filing an appeal to the Council for Conditional Use Permit 3-87 and Tentative Parcel Map 132 (condo conversion). He indicated that these items would be presented to the City Council in July. Mr. Knight also noted that at the next Planning Commission meeting, staff would include the Commission's reorganization on the agenda. COMMISSION CONCERNS There were no Commission concerns at this time. ADJOURNMENT It was the consensus of the Commission and so ordered by the Chair to adjourn the Planning Commission meeting of June 17, 1987 at 7:50 p.m. THESE MINUTES ARE TENTATIVE, SUBJECT TO APPROVAL BY THE PLANNING COMMISSION.
