MINUTES OF MEETING SEAL BEACH PLANNING COMMISSION NOVEMBER 4, 1987 The City of Seal Beach Planning Commission met in regular session on Wednesday, November 4, 1987 at 7:30 p.m. SALUTE TO THE FLAG was led by Commissioner Sharp. ROLL CALL Present: Chairman Covington Commissioner Jessner Commissioner Sharp Commissioner Rullo Absent: Commissioner Suggs (Excused absence) Also Present: Edward Knight, Director of Development Services Pam Walker, Administrative Aide Joan Fillmann, Secretary to Director of Development Services CONSENT CALENDAR MOTION MADE BY SHARP; SECONDED BY JESSNER - TO REMOVE BOTH ITEMS FROM THE CONSENT CALENDAR SO THAT PUBLIC DISCUSSION MAY TAKE PLACE ON BOTH ITEMS. MOTION CARRIED 4-0. AYES: NOES: ABSENT: Covington, Jessner, Sharp, Rullo None Suggs A. PLAN REVIEW 16-87 - 4532 GUAVA AVENUE, SEAL BEACH Staff recommended approval of Plan Review 16-87 (which requests the approval for installation of a roof-level satellite dish antenna) subject to conditions: (1) the dish being completely screened from view from streets and abutting properties by use of a permanent structure, compatible with the architectural style of the main structure, as approved by the Department of Development Services and (2) the satellite dish being an off-white or light brown color to match the dominant building color at 4532 Guava. , , . . . . . o . . Page 2 Minutes of Planning Commission Meeting 11/4/87 PETER GEDDES - 4532 GUAVA AVENUE, SEAL BEACH Mr. Geddes stated this dish is 10 feet in diameter and is to be mounted 21 feet from the ground on a pole at roof level in the rear yard. He felt the staff conditions were discriminatory as they are not required for other antennae and FCC regulations pre- empted local restrictions on antenna placement. He felt lattice work screening would interfere with his reception and that screening in general would be an eyesore. He said his intent is to paint the di sh a smokey grey to blend with the roof, rather than the off-white of the house. Ed Knight stated the C ity.s satelloite dish regullations were reviewed by the City Attorney who found it val id and not capricious. Mr. Knight said the FCC ruling referred to by Mr. Geddes further referenced cities authority to prescribe conditions to achieve aesthetic objectives and the idea of painting the dish is to enhance the area by blending the dish with the dominant building color and screening. ROBERT RINELLA - 4533 FIR AVENUE, SEAL BEACH MS. PAT AURANG - 4525 FIR AVENUE, SEAL BEACH MS. MOSKALENKO - 4541 FIR AVENUE, SEAL BEACH These neighbors spoke against approving the installation of this satellite dish, stating it could be seen from their second story windows and backyards and would be an eyesore. Chairman Covington stated that installation was allowed by statute but only if it met City regulations. MOTION MADE BY SHARP; SECONDED BY RULLO THAT PLAN REVIEW 16-87 BE GRANTED WITH THE UNDERSTANDING THAT THE SECOND STAFF REQUIREMENT BE THAT THE SATELLITE DISH WILL BE A COLOR TO MATCH THE DOMINANT BUILDING COLOR AT 4532 GUAVA. MOTION CARRIED 4-0: AYES: NOES: ABSENT: Covington, Jessner, Rullo, Sharp None Suggs * * * ITEM B: PLAN REVIEW 17-87 - 1009 - 1009 1/2 SEAL WAY Applicant Richard Elvidge requests approval of structural alterations under Section 28-2407(2)(K). Specifically, the applicant is requesting to raise the foundation of the building three (3) to five (5) feet. Ed Knight expressed concerns that this Plan Review might now be changed from simply raising the , . . . . . . . Page 3 Minutes of Planning Commission Meeting 11/4/87 foundation to removing walls and additional reconstruction. Mr. Knight suggested a continuance on this until the November 18th Planning Commission meeting. MANNY PEREZ. ARCHITECT - 3720 E. ANAHEIM ST.. LONG BEACH His interpretation is to completely rebuild the exact same structure that's presently standing but requested relief to build it three (3) feet higher than it presently is to protect the building from storm damage such as occurred several years ago. Mr. Elvide did not object to a November 18th continuance. COMMISSIONER JESSNER MADE A MOTION THAT PLAN REVIEW 17-87 BE CONTINUED TO THE PLANNING COMMISSION MEETING OF NOVEMBER 18, 1987; SECONDED BY SHARP. MOTION CARRIED 4-0. AYES: NOES: ABSENT: Covington. Jessner. Sharp. Rullo None Suggs * * * PUBLIC HEARINGS ITEM A: CONDITIONAL USE PERMIT 10-87 12071 SEAL BEACH BOULEVARD Pam Walker explained that the applicant, Carse Company, is requesting to remodel and add a pump island to an existing Unocal service station at 12071 Seal Beach Boulevard. CUP 10-87 is required to bring the station into compliance with the Municipal Code and to approve the proposed modifications. Staff recommends that the Planning Commission approve CUP 10-87, with conditions, by the adoption of Resolution No. 1482. Ms. Walker noted that only 3.7% of the site is landscaped, where Section 28-2318 requires 5% of the lot area be landscaped. Ed Knight said that when reviewing percentage requirements for the landscaping that staff looked at use rather than at the stationl s being part of the Rossmoor Cen'f"er. All other gas stations in the City fall under the 5% landscaping requirement. The Rossmoor Shopping Center will have 7% landscaping requirement and the 2% landscaping missing from the service station will be added to the shopping center1s 7%. * . . . . . . . . Page 4 Minutes of Planning Commission Meeting 11/4/87 STEVE CARSE - 325 CLAIRHAVEN, AlUlA, CA He stated that Union Oil retained Carse Company engineering firm to do this construction. They have no problem with the 5% landscaping requirement. He stated that the two existing telephone booths will remain (item 7.d). MOTION MADE BY SHARP; SECONDED BY RULLO THAT CUP 10-87 BE GRANTED WITH THE PROVISION THAT THE TWO TELEPHONE BOOTHS BE MAINTAINED ON THE SITE. MOTION CARRIED 4 - O. ORAL COMMUNICATIONS FROM THE AUDIENCE JOE RIBAL - 1215 1/2 SEAL WAY, SEAL BEACH He encouraged allowing raising foundations on Seal Way and in Surfside for the safety of the structures from storm damage and for additional parking under the houses. There is no on-street parking on Seal Way. STAFF CONCERNS Ed Knight said the City Council held their first public hearing on the Hellman Specific Plan on November 2, 1987 and continued it to their November 16th meeting. Issues on the golf course, circulation and possible recreation facilities will be addressed then. Counci 1 is aware of Commi ss ion recommendat ions on Qu imby funds being collected and in some way tied into the acquisition of the 17 .9 acre parcel and of the public %Olf course being covenanted in such a way to assure pub11c use eing irrevocable on the title. The Sunset Provision was removed from the ordinance that the Commission passed. Minimum square footage requirements were previously set by the Commlssion at 950 square feet with reconstruction subject to two findings. The ordinance will now read that there shall be a minimum of 500 square feet. Minimum lot requirements for a unit were set by the Commission at 1250 whereas the Councll estab 11shed them at 950 square feet. This provision will require the ordinance to come back to the Commission for further recommendations to Council for their December 7th meeting; a Staff Report will be provided Also, under certain emergency conditions, the provisions for a CUP and/or a Plan Revlew would be revoked to expedite reconstruction. * * * ~ COMMISSION CONCERNS - None.
