When you see that the speaker's position in the center of the room is unoccupied, step up to the microphone and when recognized by the Chairman, speak directly into the microphone by first stating your name and address clearly and distinctly for the records. State your business as clearly and Succinctly as possible and then wait a moment to see if the Commissioners have any questions in regard to your comments or questions. If there are no other questions or comments, return to your seat so that the next person may address the Commission. If you wish to address the Commission on matters other than public hearings, the agenda provides for that time when the Chairman asks for COmments from the public. PLANNING COMMISSION MEETING OF JULY 1, 1987 The Seal Beach Planning Commission met in regular session on Wednesday, July 1, 1987 at 7:30 p.m. Chairman Jessner led the Salute to the Flag. ROLL CALL Present: Chairman Jessner Commissioners Rullo, Suggs, Sharp Commissioner Covington arrived approximately 7:35 p.m. Also Present: Edward Knight, Director of Development Services Pamela Walker, Administrative Aide CONSENT CALENDAR A. Plan Review 9-87, 213 14th Street Commissioner Suggs moved to approve consent calendar as presented; Commissioner Sharp seconds. AYES: NOES: ABSENT: Jessner, Rullo, Sharp, Suggs None Covington Motion Carried . PUBLIC HEARING - CONDITIONAL USE PERMIT 6-87 - A112 SURFSIDE - RASMUSSEN Mr. Knight indicated this item was continued from the June 17, 1987 meeting in order to allow staff to obtain additional information on the design of the storage area requested as an addition to a nonconforming property located at Al12 Surfside. The Planning Commission raised questions regarding the number of windows proposed for the storage room. Knight explained the applicant indicated the windows were for the purpose of allowing light and would agree to fewer windows if the Commission desired. Staff recommended approval of this matter subject to the two conditions placed in the staff report of July 1, 1987. . Chairman Jessner declared the public hearing open. As no persons spoke in favor nor in opposition to the matter, the public hearing was closed. Jessner indicated it was the Commission's and staff's understanding that the applicant would be present to answer the Commission's questions. Knight stated the applicant indicated the windows in the storage area were to allow light and that the applicant's children would use the area to work on their surfboards. It was also mentioned that Surfs ide Colony has provided written verification that the storage area does not encroach into their easement. Commissioner Sharp moved to hear this item at the end of agenda to allow applicant to appear; Covington seconds. AYES: ABSTAIN: Covington, Jessner, Sharp, Suggs Rullo Motion Carried 1 . Commissioner Rullo explained City Attorney had advised him to abstain from this matter as he was a member of the Surfside Colony Board. . SCHEDULED MATTERS- PLAN REVIEW 10-87 - 135 COTTONWOOD - DENNIS SCHEELE Ms. Walker indicated Plan Review 10-87 is a request by Dennis Scheele for architectural review of a proposed second story cabana located within the Seal Beach Trailer Park. Ms. Walker stated a copy of the guidelines governing the development of 2- story cabanas were submitted to the Commission. Staff felt the proposed cabana met the requirements and standards outlined in the Code, and therefore, recommended approval of the request with five conditions noted in the staff report. In response to Commission questions, it was explained that .the entire first floor was a mobile home, that the second story would consist of the cabana. The stairway is fixed and attached to the second floor. Covington pointed out this is a second story addition to the first floor trailer, rather than a two story cabana. It was pointed out that the adjacent neighbors do not have two-story cabanas. According to staff, the Code requires that no two-story cabanas can be located closer than 20 feet. Covington felt that the original intent of that code was that no two-story cabanas can be located closer than 20 feet or on contiguous lots. Jessner concurred in that statement as the Fire Department made that request to allow for access. Staff indicated that the proposed improvement was not contiguous to a lot with a two story cabana nor closer than 20 feet to a two-story cabana, therefore it met the intent of the code requirement. Covington requested staff to review that portion of the code regarding contiguous lots. Sharp moved to approve Plan Review 10-87; Covington seconds. AYES: NOES: Covington, Jessner, Rullo, Sharp, Suggs None Motion Carried SCHEDULE MATTERS - MEASUREMENT OF FENCE HEIGHT Mr. Knight indicated that at a recent public hearing, some clarification was requested regarding fence height regulations within the City. Staff prepared a report defining retaining walls, fence heights, pool fences, and 8 foot fences, including llustrations of those items. . Staff indicated that the methods for measuring fence height are clearly specified in most cases. With the exception of the question of whether to measure from natural or finished grade, the code leaves no latitude for interpretation. To the concern of measuring fences from finished grade or artificial grade, staff indicated it will do so only when finished grade is established for structural, draining or safety purposes. Knight 2 . indicated these points and guidelines should clarify the methodology employed to measure fence height and recommended the Commission receive and file the report. Responding to Commission, Knight indicated staff felt comfortable using finished grade terminology for future and past practices in determining fence measurement. Commissioner Covington requested an additional illustration of the 42" forward fence as brought out in the public hearing regarding 340 Ocean Avenue. Commissioner Covington also requested item B of the report be restated so as not to provide opportunity for disagreement between neighbors, should property owners on either side of fence have varying finished grades. Covington suggested wording of D(3) be changed to add "adjoining College Park East homes" after "flood control channel" and "adjoining College Park West homes" after "Edison Park". Covington also felt artificial grade was not acceptable for measurement as it might have effect upon neighbors. Knight explained that a homeowner changing the grade at this site would have plans reviewed as it related to drainage for the adjacent neighbors. With those changes noted above, Commissioner Sharp moved to receive and file report; Covington seconds. AYES: Covington, Jessner, Rullo, Sharp, Suggs NOES: None Motion Carried . PUBLIC HEARING - CONDITIONAL USE PERMIT 6-87 - AGENDA ITEM HELD OVER FROM BEGINNING OF AGENDA Commissioner Sharp moved to continue item to next meeting and request applicant to appear; Commissioner Covington seconds the motion. Staff agreed to apprise the applicant that the July 20th meeting will be the last continuation. AYES: Covington, Jessner, Sharp, Suggs NOES: None ABSTAIN: Rullo Motion Carried STAFF CONCERNS Planning Commission reorganization will occur at the July 20th meeting. COMMISSION CONCERNS There were none at this time. ADJOURNMENT With the consent of the Commission, Chairman Jessner adjourned the meeting of July 1, 1987 at 8:35 p.m. .
