CITY OF SEAL BEACH PLANNING COMMISSION MEETING MINUTES of JANUARY 5, 1994 The regularly scheduled Planning Commission meeting of January 5, 1994 was called to order by Chairman Dahlman at 7:35 p.m. in City Council Chambers. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Chairman Dahlman. CONSENT CALENDAR 1. Minutes of December 8, 1993 Chairman Dahlman asked the following two changes be inserted into the Minutes on page 5: Line 7: Line 28: " . . ., this staff report did not include old Minutes, ... . Mr. Tahvildari stated Papillon's had not been in violation of any of the conditions of its CUP. AGENDA CHANGES Director Whittenberg indicated agenda item #10, Conditional Use Permit #93-15 for Ruby's Restaurant will not be considered this evening because the applicant is revising their plans and has requested this item be continued to January 19, 1994. No public testimony will be taken this evening. Additionally, Director Whittenberg indicated the City Attorney's Office provided a memorandum on agenda item #8, Conditional Use Permit #93-14 for Double-D's Dockside Cafe located in Sunset Aquatic Park. The memo states this application should be removed from the agenda. Mr. Steele explained the Government Code provides that cities and counties are not subject to each other's zoning and building laws for projects that happen on land owned government entity within another entity's boundaries. Once a government property owner has approved a land use, then an additional government entity can't interfere with that land use. This land is owned by Orange County and is only accessible from Huntington Beach or by boat. What complicated this issue, is that there's a lessee (Double D's Dockside restaurant) of the County property. Orange County will be conditioning this use by (1) their park and beach alcohol rules apply and (2) this type of use is conditioned through their lease with Orange County which includes specific provisions on the land use. The Board of Supervisors must approve that lease and its provisions. Without objection from the Commission, Chairman Dahlman dismissed this item from tonight's agenda. Chairman Dahlman proceeded to Scheduled Matters, coming back to the remaining Consent Calendar item. IV. SCHEDULED MATTERS Resolutions to be Adopted: 3. They disagreed on what is permitted in Seal Beach for a restaurant. It was his feeling that if you have a CUP for a restaurant that facility needs to operate as a restaurant --- if not all the time at least almost all the time. "There's a minority opinion that you can operate as a bar part of the time as long as less than 50% of your revenue is generated by bar activities and alcohol sales". He asked staff for clarification. Director Whittenberg said the CUP process only applies where there is an on-premise sale of alcoholic beverages. The ABC rules require that no more than 50% of the sales from a licensed establishment derive from the sale of alcoholic beverages. The City's municipal ~ does not stipulate what type business operation differentiates a restaurant from a bar, other than the fact that food is served at a restaurant. Papillon's restaurant is in compliance if they are not providing food on Monday nights, when the football games are on shown on their television, as long as during that fiscal quarter their sale of alcohol does not exceed 50% of their total sales. The City doesn't have the authority to step into that area of control which the State has already preempted. Chairman Dahlman said he felt anyone reading the ABC's rules which say no more than 50% of your sales can be from alcohol, would interpret those rules to mean such establishment is open as a restaurant while generating those sales. If not, an establishment could be open as a bar three nights a week and as a restaurant four nights a week --- when the CUP is for alcohol service at a restaurant. Mr. Whittenberg said the City's CUP is for an on-premise alcoholic beverage sale. A City permit is not needed to open and run a restaurant. Chairman Dahlman said the City's municipal Code does not permit bars. If an applicant comes to the City for a permit for a restaurant with alcohol sales it is conditionally approved. "We need to explore this further. If I could take back every vote I ever gave for an alcohol-related use on Main Street if they're allowed to operate a bar as long as they're sales don't exceed 50% alcohol". Mr. Whittenberg said that if they don't exceed 50% of gross sales in alcohol sales the establishment meets the definition of a restaurant. The figures are related to a total amount of sales over a three month time period. Seal Beach l'IaIIDluc CommlssloD Minutes for JauU8l1 5, 1!l!I4 Mr. Curtis said the CUP approval for Papillon' s restaurant pre-dates a Condition of Approval that is now routinely placed on CUPs --- that is that the establishment have a full menu available until thirty minutes prior to closing. The next review of Papillon's could include amending their CUP to include this condition. That would preclude nights of just having their bar open. When this issue was previously discussed, Mr. Tahvildari did indicate that he had a SPecial menu for Monday nights, an extensive oyster bar, which included hamburgers and sandwiches. He brought the menu before the Commission for their review and the Commission agreed it was sufficient and not just snacks. Chairman Dahlman said there must be food service. If the restaurant is closed and there's a private party that's O.K. because it's private. However, if the restaurant is closed but the frontlbar part is open and people are drinking while watching football --- "Then we have another bar in town ... we are pushing the envelope in that one location " MOTION by Sharp; SECOND by Law to approve Resolution No. 93-53. Renee Bollen requests to add a sixty square foot, detached laundry room at the rear of a nonconforming four unit apartment at 1114 Ocean Avenue, Seal Beach. Commission Comments on Staff R~port Chairman Dahlman felt this is a model application for remodel of a nonconforming apartment because they have ten parking spaces and are required to have eight. Staff R~rt Mr. Curtis presented the staff report. [Staff report on flle in the Planning Department]. The applicant, Cary Hardwick, requests an indefinite extension for an alcohol-related land use at Tortilla Beach restaurant. Mr. Curtis said his inspection of this restaurant revealed they were meeting all their Conditions of Approval except #21, which prohibits live entertainment. The applicant has received authorization from the City Manager's Office (a Special Activities Permit) to provide live entertainment on an eight week trial basis. He felt the City Council should renew their request for this to be done. This was requested over one year ago. Mr. Whittenberg said this permit relates to alcoholic beverage sales. The City Manager's Office is working on the entertainment ordinance. The Public Hearing was closed. Commission Discussion Chairman Dahlman read the definition of "restaurant" from the Code. [Staff report on file in the Planning Department]. The applicant's agent, Fred Middaugh, Esq., requests an indefmite extension of an alcohol-related land use entitlement at Cafe Lafayette. Mr. Curtis suggested the Commission could consider a request for extended hours to put them on a par with other similar establishments; they close at 9:00 p.m. as opposed to 10:00 p.m. Chairman Dahlman pointed out the Notice did not advertise extended hours and that issue would have to be advertised. Commission Comments on Staff Re.port There were no Commission comments. Public Hearing Fred Middaugh. Esq. * (No Address Given) * Seal Beach Mr. Middaugh said his client concurs with the staff report but asked if the posting of the Conditions of Approval (Condition #7) could be done in such a way to take as little space as possible. Mr. Whittenberg suggested simply tacking them as one document on a bulletin board. Mr. Middaugh agreed. No one wished to speak in favor or against this application and the Public Hearing was closed. Commission Discussion Mr. Whittenberg suggested amending Condition #20 as done for the previous application. He suggested the Policy Statement be amended also so further applications would read the same. The Commission agreed. Chairman Dahlman asked Mr. Whittenberg questions relating to the Backstop R u Ie. VITI. COMMISSION CONCERNS Change of Planning Commission Day and Time Commissioner Sharp asked to have the Planning Commission's meeting time changed from 7:30 p.m. to 7:00 p.m. This would put the Council and Commission meetings at the same time. Also, the Commission will be into the Bixby hearings in the near future and they will undoubtedly be long hearings. He asked this be placed on the next agenda. Chairman Dahlman said it would be nice to consider a different day also. Revise Housing Element Chairman Dahlman asked for discussion on recommending to the City Council to modify the Housing Element to incorporate the Los Alamitos ACUlZ Study. Mr. Whittenberg said this was not agendized because, since the last Commission discussion on December 8th, the City received a Final Draft ACUlZ Study from the AFRC. That document is designed to inform surrounding community of the impacts of their current and anticipated future operations would cause to the surrounding community. On January 10th, there will be a Council report with a comment letter back to the AFRC. The City's aviation consultant for the Bixby project and staff have looked at this draft ACUlZ study and have serious concerns on its adequacy. Until this document is in a final form he felt it would be premature to consider using that document for any other purpose. The study indicates there are federal Department of Defense (DOD) guidelines for the establishment of "clear zones" at the end of runways. The study then varies from those definitions of clear zones and establishes other clear zones without any real discussion as to how they came to a determination to make the modification. If there is faulty analysis it could have serious impacts on the City. Commissioner Campbell said she wants the EIR's aviation report and the ACUIZ study to be incorporated into the Housing Element. Mr. Whittenberg said the two documents are inter-dependent and cannot be separated. The time frame for the EIR is not known and the ACUlZ study's fmal comments are due on January 14th. Chairman Dahlman said it seems unfair to the Bixby Co. to prepare an EIR without knowing what the ACUlZ study states and what will be agreed to for the clear zones. How can they submit a plan until they know what the City has agreed on? Mr. Whittenberg replied that Bixby Co. has submitted a plan because an ACUlZ study was to have been issued in 1989. It was withdrawn by the Federal Government. Recently the AFRC received DOD authorization to prepare a new study. Chairman Dahlman said he is concerned about litigation. IllH information; the EIR will not be released for review until the ACUIZ study is final and its information can be incorporated into the EIR's analysis. If the ACUIZ study remains in its present format, which does not indicate any clear zones extending off the base, the City's consultants may indicate they feel that is not adequate and additional clear zones need to be identified. The ACUIZ study is being prepared by the AFRC, the California National Guard. Bixby Proposal Gated? Commissioner Law asked if Bixby would be a gated community? Mr. Whittenberg said he didn't think the plans indicated gates. Commissioner Campbell said it would probably be gated because the proposal is in the middle of the golf course and the golf course is gated. Mr. Whittenberg indicated issues relating to the Bixby project should be considered at the time of Public Hearings, when all information is available. New$t)aper Racks Chairman Dahlman said there is a row of six newspaper stands in the 200 block of Main Street which prohibit getting from your car to the sidewalk. Mr. Whittenberg said the City Attorney's Office is drafting an ordinance to regulate newspaper racks. This is expected in mid-February. The Planning Department will be going out on Main Street and laying out all the separate items which require certain distances from other structures. Toxic Fumes * Exxon Shut Down Chairman Dahlman referenced a current newspaper article which stated toxic fumes noted in a routine sampling of sewer water by First Street. The Orange County Fire Department had readings up to 80 % of the limit for a low level explosion. All traffic was stopped and by 4:00 p.m. the levels were below 10%. Mr. Whittenberg said the Orange County Fire Department Hazardous Response Team, the Air Quality Management District and the Orange County Sanitation District were out to the site. The Exxon oil separation facility has been shut down, Orange County Sanitation District pulled their operating permits until such time as Exxon can determine what caused the problem and how they will rectify it. Exxon will not continue to operate until they can satisfy the above agencies that they can accomplish this task. The City closed down the residential area around it and did not allow people to drive in because they didn't want a spark to set off an explosion.
