'\. .~ CITY OF SEAL BEACH PLANNING COMMISSION MINUTES of APRIL 20, 1994 The City of Seal Beach Planning Commission met in regular session at 7:30 p.m. with Vice Chairman Soukup calling the meeting to order with the Salute to the Flag. ROLL CALL Present: Vice Chairman Soukup Commissioners Law, Campbell, Sharp Also Present: Department of Development Services: Lee Whittenberg, Director Craig Steele, Assistant City Attorney Barry Curtis, Administrative Assistant Joan Fillmann, Executive Secretary Absent: Chairman Dahlman APPROVAL OF AGENDA Staff requested Item US, Minor Plan Review #94-2, be removed from the Consent Calendar for discussion because the Consent Calendar needs to indicate what action is proposed for that matter. Since this is not shown on the Agenda, staff requests it be moved to allow discussion. In the future, the Agenda will show the listing of the various items and a recommended Commission action. Staff indicated Item #6, Variance #94-1, was requested to be continued by the applicant. It was determined this item will be scheduled for the May 4, 1994 meeting. Staff recommended Item #8, General Plan Amendment #94-1 and Zone Change #94-1 be rescheduled to allow re-Noticing. The Commission discussed the fact that Commissioner Campbell will be absent from the May 18th meeting and Commission Soukup will be out of the city for three weeks beginning May 20th. It was agreed to reschedule this item for the June 22, 1994 meeting. MOTION by Sharp; SECOND by Law to approve the Planning Commi~ion Agenda of April 20, 1994 as amended. Receive and File: Seal Beach Naval Weapons Station - Installation Restoration Program; Status Report. Mr. Steele explained several reasons to request an agendized item be pulled from the Consent Calendar, such as (1) members of the public who want to speak on an issue and either a member of the public, staff or a Commission member may request an item be pulled for that reason; (2) if a Commissioner anticipates voting no or against the staff recommendation on an item, that would be a reason to pull it; (3) if Commission has questions of staff, the public or anticipates some discussion among the Commission. Vice Chairman Soukup stated an Orange County Register article had a misunderstanding of the Consent Calendar in an article, noting the article said the Planning Commission was going to review Item #4 instead of receive and f1le Item #4. . Minor Plan Review #94-2 218 Fourth Street Staff Report Mr. Curtis presented the staff report; staff report on ftle in the Planning Department. The applicant, Stephen Wack, is the contractor for Don Wasson, the property owner. The request is for the addition of 120 square feet to a non-conforming garage which is non-conforming due to inadequate side and rear yard setbacks. Mr. Curtis said he spoke with the applicant who agreed to amend his application to provide the required 9' setback for all parts that are being added so the addition will not compound the existing non-conformity. Mr. Curtis read the four Conditions of Approval and recommended a fifth Condition be added: 5. The plans be amended to provide a minimum setback of nine feet (9') for any additions being proposed. . Commission Comments on Staff Report The Commission asked about fireproofmg the garage. Mr. Curtis explained it would need required drywall, openings sealed, and be taped and mudded. Vice Chairman Soukup said the plans the Commission is looking at do not indicate the addition will be set back an additional few feet. Mr. Curtis agreed, noting this was discussed after the application was submitted. Commission Comments MOTION by Sharp; SECOND by Law to approve Minor Plan Review #94-2 with a rUth Condition of Approval included as stated above. Variance #94-2 Conditional Use Permit #94-2 Height Variation #94-2 1603 Seal Way Staff R~rt Mr. Curtis presented the staff report; staff report on file in the Planning Department. The applicants, Joe and Adrienne Kalmick, requested the addition of a second story living room with roof deck, expansion of existing a second story master bedroom and deck and covered roof access structure. The property is non-conforming property due to inadequate setbacks. Mr. Curtis noted staff received a letter in support of this application from Sharon and Donald Davis, 109 Electric Avenue, Seal Beach. Commission Comments on Staff R~ort Vice Chairman Soukup asked Mr. Curtis to explain the staff report's statement" ... will serve no public purpose". Mr. Curtis explained that requiring the applicant to move the second story back five inches while allowing the garage to remain in its present position would serve no practical purpose or public good. The Commission noted the garage in question would not be undergoing any remodeling and asked if the building would be re-stuccoed or repainted on the outside. Mr. Curtis said yes. Public Hearing Joe Kalmick * 1603 Seal Way. Seal Beach Mr. Kalmick introduced himself as the applicant and property owner. He explained his proposal is to add a second story living room to the front of his house. They are converting from three bedrooms, two and a half baths to two bedrooms and two baths. He indicated his neighbors to the East and West have given him verbal approval to indicate their full support. No one in the audience wished to speak for or against this proposal. The applicant did not wish to rebut and the Public Hearing was closed. Commission Comments Vice Chairman Soukup asked Commissioner Law how she liked the covered roof access structure (CRAS) and the glass block? Commissioner Law said she admired the design because it matched the rest of the glass block used in the design and she felt it is definitely not a quasi- observatory . . . . Page 5 - City of Seal Beach PIannin,g Commission Agenda of April 20, 1994 Mr. Steele explained to the Commission staff will be bringing back three separate resolutions for this application. He suggested a change to CUP #94-2's Conditions of Approval #4, suggested the wording be " The applicant shall record a covenant in a form acceptable to the Director of Development Services... II. This would run with the land and would bind future owners of this property to the single family designation. MOTION by Sharp; SECOND by Campbell to approve Variance #93-2 through the adoption of Resolution No. 94-(11). - MOTION CARRIED: A YES: ABSENT: 4-0-1 Sharp, Campbell, Soukup, Law Dahlman *** MOTION by Sharp; SECOND by Campbell to approve Conditional Use Permit #94-2 through the adoption of Resolution No. 94-(12), with a modification to Condition #4 as stated above. Page 6 - City of Seal Beach Planning Commission Agenda of April 20, 1994 Vice Chairman Soukup asked if he could make comments of a political nature (inaccurate fliers from candidates running for City Council) at this time? Mr. Steele said Commission concerns are defined as matters falling within the subject matter jurisdiction of this Commission. Commission comments should be held to matters relating to land use decisions. Commissioner Law said the safety chain is down again at the access road near Seal Beach Boulevard and Lampson Avenue. Mr. Whittenberg said he will speak directly to the Bixby Company. Mr. Steele repeated his caution, that when Commission concerns are to be discussed at a meeting, Commissioners should notify Planning Department staff in advance so those concerns may be agendized. MY WIFE SHARON AND I HAVE LIVED IN SEAL BEACH FOR THE PAST THIRTY YEARS AND SELDOM FOUND IT NECESSARY TO COMMUNICATE WITH THE PLANNING COMMISSION OR THE CITY COUNCIL. THIS LETTER IS TO ASK FOR YOUR UNANIMOUS SUPPORT FOR BOTH VARIANCE #94-2 AND CONDITIONAL USE PERMIT #94-2 AS REQUESTED BY JOE AND ADRIENNE KALMICK FOR THEIR RESIDENCE AT 1603 SEAL WAY.
