ROLL CALL m AGENDA APPROVAL By Motion of the Planning Commission, this is the time to: (a) Notify the public of any changes to the Agenda; (b) Re-arrange the order of the Agenda; and/or (c) Provide an opportunity for any member of the Planning Commission, staff, or public to request an item is removed from the Consent Calendar for separate action. IV. ORAL COMMUNICATIONS At this time, members of the public may address the Planning Commission regarding any items within the subject matter jurisdiction of the Planning Commission, provided that the Planning Commission may undertake no action or discussion unless otherwise authorized by law. V. CONSENT CALENDAR Items on the Consent Calendar are considered to be routine and are enacted by one motion unless, prior to enactment, a member of the Planning Commission, staff or the public requests a specific item be removed from the Consent Calendar for separate action. 1. Receive and File: Staff Report, dated July 14, 1997, Subject: Orange County Council of Governments - Draft Report n Regional Performance Indictors. 4. Consider Processing a Zoning Text Amendment re: Permitted Uses at Automobile Service Stations. 5. Consider Processing a Zoning Text Amendment re: Exterior Staircases. ROLL CALL Present: Chairman Brown Commissioners Hood, Yost, Law, Sharp Also Present: Department of Development Services Lee Whittenberg, Director Craig Steele, Assistant City Attorney Barry Curtis, Associate Planner Joan FilImann, Executive Secretary AGENDA APPROVAL Chairman Brown asked for a status on July 9th Planning Commission actions. Mr. Whittenberg said the resolution for the Seal Beach Market would be brought back at the next meeting for review and signature. Mr. Whittenberg explained that item #4, the consideration of processing a Zoning Text Amendment regarding permitted uses at automobile service stations had been withdrawn because Arco had withdrawn their application. MOTION by Yost; SECOND by Law to approve the agenda as amended. MOTION CARRIED: AYES: 5-0-0 Yost, Law, Sharp, Brown, Hood ORAL COMMUNICATIONS There were no oral communications. CONSENT CALENDAR MOTION by Hood; SECOND by Yost to approve the Consent Calendar with two corrections to the Minutes of July 9, 1997 as follows: Page 5: Paragraph 5, change "emergency" to "energy". Page 8: Paragraph 10, change "a full year" to "an indefinite extension". Receive and File: Staff Report, dated July 14, 1997, Subject: Orange County Council of Governments - Draft Report on Regional Performance Indicators. MOTION CARRIED: AYES: 5-0-0 Law, Brown, Hood, Sharp, Yost It was again indicated that item #4 had been pulled from the agenda 5. Consider Processing a Zoning Text Amendment re: Exterior Staircases. Staff Report Mr. Curtis delivered the staff report. [Staff report on file in the Planning Department for reference]. He explained that in 1993 the City adopted a ZTA which prohibited exterior stairwells to second stories in single family dwelling. Recently a Hill-area resident, David Prime, brought a situation to staff's attention that several homes on the Hill were constructed with their kitchen on the second floor. This situation caused inconvenience in the use of their back yard. MOTION by Sharp; SECOND by Hood to recommend to the City Council to proceed with a ZT A to consider amending the municipal Code to allow exterior stairwells to the second floor of residences in the RLD zone which have original, existing second floor kitchens. Negative Declaration 97-2 and Revision 97-1 of the Safety Element of the General Plan Staff Report Mr. Whittenberg presented the staff report. [Staff report on file in the Planning Department for reference]. Mr. Whittenberg explained that in 1971 the State required all cities and counties to adopt Seismic and Safety Elements as part of their General Plans. He explained the basic objection of a Safety Element and its organization. Commission Ouestions to Staff Chairman Brown asked what this Element would be used for? Mr. Whittenberg said it would ensure compliance with State law. Additionally, it will be used in evaluation projects to identify where access and fire hazard concerns are. Public Hearings There were no comments either for or against this item. The Chairman closed the Public Hearing. e Commission Comments MOTION by Hood; SECOND by Yost to adopt Resolution No. 97-16, approving recommending to the City Council adoption of Negative Declaration 97-2 and adoption of Revision 97-1 to the Safety Element of the Seal Beach General Plan with any revisions determined appropriate. MOTION CARRIED: AYES: 5-0-0 Hood, Yost, Brown, Law, Sharp STAFF CONCERNS There were no staff concerns. COMMISSION CONCERNS Commissioner Yost said there is a possibility he would not be present at the August 6, 1997 meeting.
