City of Seal Beach Planning Commission Minutes of August 6, 1997 Chairman Brown called the regularly scheduled Planning Commission meeting of August 6, 1997 to order at 7:30 p.m. in City Council Chambers. Roll Call Present: Chairman Brown Commissioners Hood, Yost, Law, Sharp Also Present: Department of Development Services Lee Whittenberg, Director Quinn Barrow, City Attorney Barry Curtis, Associate Planner Joan Fillmann, Executive Secretary Absent: Craig Steele, Assistant City Attorney AGENDA APPROVAL MOTION by Yost; SECOND by Sharp to approve the Agenda as presented. MOTION CARRIED: AYES: 5-0-0 Yost, Sharp, Law, Brown, Hood CONSENT CALENDAR MOTION by Hood; SECOND by Law to approve the Consent Calendar as presented: 1. Planning Commission Minutes of July 23, 1997; and 2. City of Seal Beach Plmming Commission * Minutes of August 6, 1997 SCHEDULED MATTERS - 3. Resolution No. 97-15 * Seal Beach Market Chairman Brown said Resolution No. 97-15, as presented, does not reflect the dialog at its Public Hearing. Section 4 should include an additional finding to indicate the market is not currently serving distilled spirits. Section 5, should be changed to reflect they are not selling distilled spirits. The Commission determined to return this resolution to staff for correction and presentation at the August 20th meeting. PUBLIC HEARINGS 4. Housing Element Revision 97-1 Applicant: City of Seal Beach e Staff Report Mr. Whittenberg presented the staff report. [Staff report on file in the Planning Department for inspection]. Director Whittenberg explained the Government Code requires a Housing Element to include an analysis of existing assisted housing development. That w~uld be eligible to change from low-income housing uses during the next ten years due to termination of subsidy contracts, mortgage prepayments or expiration of restrictions on use. Revision 97-1 addresses this specific provision in the Government Code. Staff analyzed all the housing in the City of Seal Beach and found there are no existing assisted multi-family housing units which are subject to this section of the Government Code. Staff is suggesting an amendment to the Housing Element, which would add a paragraph noting this analysis. Commission Ouestions to Staff Chairman Brown asked if the Naval Weapons Station housing would have any part in this analysis? Mr. Whittenberg said the Navy's housing cannot count toward any requirements of the City, they are exempt. Public Hearing There were no persons wishing to speak for or against this matter. The Chair closed the Public Hearing. Commission Comments MOTION by Sharp; SECOND by Hood to approve Resolution No. 97-18, recommending to the City Council adoption of Housing Element Revision 97-1. MOTION CARRIED: 5 - 0 - 0 AYES: Hood, Law, Yost, Brown, Sharp e 2 City of Seal Beach Plmming Commission · Minutes of August 6, 1997 . The Commission asked if there would be an appeal period? Mr. Whittenberg said no, because this item will go to the City Council for another set of Public Hearings. Staff Concerns Mr. Whittenberg expressed his appreciation to Commissioner Sharp for his eleven years of service on the Planning Commission and noted staffwill miss him. Commission Concerns All the Commissioners expressed their feelings at the retirement of Commissioner Sharp and said they will miss him but appreciate his years of service. Commissioner Hood asked if the Planning Commission had held any closed meetings? He wondered how much a lawsuit to defend a suit for alleged Brown Act violations would cost the City? e City Attorney Barrow said there is a process a person has to go through before a lawsuit can be filed on alleged Brown Act violations. In the last fifteen years he could recall approximately six instances where someone alleged a Brown Act violation. But no one has gone through the process to file a lawsuit. Therefore, he didn't know how much it would cost to defend. It's a quick proceeding, not a trial, it would be a Writ of Mandamus, a one or two hour trial before a judge without a jury. Currently there is no cost to the City of Seal Beach, no billable hours as the matter would come under the City's retainer. It would have to reach a much higher level before it reaches a litigation level, at which time it would begin costing the City additional money. Commissioner Sharp said he could not recall the Planning Commission's ever having a closed meeting. Mr. Whittenberg said the question was not directed to the Planning Commission, but to the City in general. The Planning Commission cannot hold closed sessions. Commissioner Sharp said he wanted to address Mr. Stark's comments at the last City Council meeting. "I want everybody to understand that I have served on this Commission for eleven years and I have found the staff, as well as the City Manager and the City Clerk and all of them that served in there to above-board, honest and hard working. And I think we have one of the finest staff's doing one of the finest jobs of any city of this size in the country. So; regardless of what Stark says, it's tongue in cheek, because he's holding back a lot that isn't honest and putting out a lot that isn't honest and holding back a lot of the truth. And I wanted to get that on the Record. I am certainly going to miss being here and I'm going to miss the people I served with. And I'm just sorry to be leaving". e 3 . e e .
