RESOLUTION NUMBER 1468
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SEAL BEACH APPROVING CONDITIONAL USE
PERMIT 7-87, A REQUEST TO PERMIT ON-SALE BEER
AND WINE IN CONJUNCTION WITH A NEW RESTAURANT
(900 OCEAN AVENUE)
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
WHEREAS, on May 27, 1987, a representative of Ruby's Diner,
Inc., submitted an application for Conditional Use
Permit 7-87 to the Seal Beach Department of Development
Services; and
WHEREAS, the applicant is requesting approval of an on-sale beer
and wine license to be used in conjunction with Ruby's
Diner, a new restaurant located at 900 Ocean Avenue,
Seal Beach, California; and
WHEREAS, the restaurant is located at the end of the recently
rebuilt Seal Beach Municipal Pier; and
WHEREAS, the surrounding land uses and zoning are as follows:
North -
a mix of commercial and residential uses in
the C-l (Service commercial) and R.H.D.
(Residential High Density) zones.
South -
the beach located in the P.L.U. (Public Land
Use) zone.
East -
a mixture of multi-family and single family
uses in the R.H.D. (Residential High Density)
zone.
West -
municipal beach and pier
park area in the P.L.U.
zone; and
parking area and
(Public Land Use)
WHEREAS,
Ruby's Diner will occupy
owned, 2,679 square foot
Seal Beach Pier; and
the newly completed, City
restaurant at the end of the
WHEREAS, the Seal Beach Pier was severely damaged by storms in
January 1983, and reopened after reconstruction in
January 1985; and
WHEREAS, the restaurant's hours of operation will be 7:00 a.m.
to 11:00 p.m., Monday through Sunday; and
WHEREAS, William Stearns, Acting Chief of Police, has reviewed
the existing records and has no reservations about
permitting the operation to commence; and
WHEREAS, with the applicant's consent, hours of operation shall
be from 7:00 a.m. to 11:00 p.m., Monday through Friday;
and
WHEREAS, the request is compatible with the surrounding land
uses, the community in general, and the General Plan;
and
WHEREAS, a duly noticed public hearing was held on August 19,
1987.

NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the
City of Seal Beach does hereby approve Conditional Use Permit 7-
87 subject to the following conditions:
1. CUP 7-87 is approved for on-sale beer and wine at 900
Ocean Avenue, and is issued to Ruby's Diner, Inc.
2. All alcoholic beverages sold in conjunction with the
restaurant operation shall be consumed entirely on the
premises.
3. There shall be no alcoholic beverages advertising in
the window areas.
4. The applicant shall comply with all restrictions placed
on the ABC license by the California Department of
Beverage Control.
5. CUP 7-87 is non-transferable.
6. CUP 7-87 shall be granted for one year, after which
time the Planning Commission will review the CUP and
may extend it indefinitely.
7. Hours of operation shal be from 7:00 a.m. to 11:00
p.m., Monday through Friday.
8. No video games or similar amusements shall be permitted
on the premises.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the
City of Seal Beach at a meeting thereof held on the 19th day of
August, 1987 by the following vote:
