HomeMy WebLinkAboutPC Res 1466 - 1987-08-05 e e RESOLUTION NUMBER 1466 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING CONDITIONAL USE PERMIT 8-87, A REQUEST TO PERMIT LIVE ENTERTAIN- MENT AND DANCING IN CONJUNCTION WITH AN EXISTING CHINESE RESTAURANT (12309 SEAL BEACH BOULEVARD) WHEREAS, on June 30, 1987, Chai Te Chang submitted an application for a conditional use permit to the Department of Development Services; and WHEREAS, the applicant is requesting approval of the addition of live entertainment and dancing to Chang's Gourmet, 12309 Seal Beach Boulevard; and WHEREAS, the restaurant is located within the Rossmoor Business Center, a multi-tenant commercial center in the C-2 (General Commercial) zone; and WHEREAS, the surrounding land uses and zoning are as follows: North and south - a mixture of general commercial uses within the Rossmoor Business Center, and single family and multiple family homes in Rossmoor, an unincorporated community of Orange County. East - a mixture of open space uses in the R-G zone, retail - commercial uses in the C-2 zone, and residential uses in the City of Los A1amitos. West - multiple family residences in the City of Seal Beach and Rossmoor; and WHEREAS, the location (12309 Seal Beach Boulevard) has a history of providing live music and dancing under prior tenants. The Rossmoor Inn offered live music and a full dance floor from 1961 to the late 1970's, and the Sly Fox Restaurant provided live music on weekends from 1984 to 1985; and WHEREAS, entertainment cafes are subject to the City's business regulations as outlined in Section 11-44 of the Code of the City of Seal Beach; and WHEREAS, a duly noticed public hearing was held on Wednesday, August 5, 1987; and WHEREAS, the Planning Commission finds that due to the history of live entertainment on the site, the general commercial nature of surrounding uses, and the stipulations imposed on this conditional use permit, CUP 8-87 is compatible with the surrounding land uses and the neighborhood in general. NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Conditional Use Permit 8- 87, subject to the following conditions: 1. CUP 8-87 is approved for live entertainment at Chang's Gourmet, 12309 Seal Beach Boulevard, and is issued to Chai Te Chang. 2. CUP 8-87 is nontransferable. e e Resolution Number 1466 Page 2 3. Entertainment shall be limited to the bar area and the tables immediately adjacent, as outlined on the plans approved by the Planning Commission (Exhibit A). No minors may be permitted in this area unless accompanied by a parent or guardian. 4. Dancing and dance bands or disc jockeys shall be limited to Wednesday through Saturday nights, between the hours of 6:00 p.m. and 1:00 a.m. 5. Solo musicians shall be permitted on Sundays through Saturdays, between the hours of 6:00 p.m. and 1:00 a.m. 6. A copy of the business regulations for entertainment shall be posted on the premises in a conspicuous location. 7. All on-site, outdoor signage associated with the live entertainment shall be approved in advance by the Department of Development Services. 8. CUP 8-87 shall be granted for six months, after which time the Planning Commission shall review the CUP and may extend it indefinitely. 9. During the time that live entertainment is taking place, the rear service door on the northern side of the building shall remain closed to prevent noise transmission.
