A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL
BEACH DENYING VARIANCE 6-87, A REQUEST TO ADD A TWO-CAR
GARAGE AND A MASTER BEDROOM SUITE TO A NON-CONFORMING
TRIPLEX AT 326 12TH STREET
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
WHEREAS,

WHEREAS, the applicant is requesting approval for the
construction of two garage parking spaces and a 454
square foot master bedroom suite (bedroom and bathroom)

WHEREAS, the subject property is a rectangular lot measuring 25
feet by 117.5 feet, or 2937.5 square feet; and
WHEREAS, the property is developed with a single story triplex
and storage shed which are nonconforming due to excess
density, inadequate parking, insufficient front and
rear setbacks, and substandard unit size; and
WHEREAS, the overall density of the subject property is 44.5
units per acre; and
WHEREAS, the applicant is specifically seeking a variance for
the following reasons:

WHEREAS, a duly noticed public hearing was held by the Planning
Commission on July 15, 1987; and
WHEREAS, the Planning Commission makes the following findings:
1. The variance request would not adversely affect
the general plan, as the proposed improvements
would only enlarge an existing unit and increase
the available covered parking rather than impact
the density on site.

2. There are no special circumstances pertaining to
the property such that the strict application of
the zoning ordinance deprives the property of
privileges enjoyed by other property in the same
vicinity and zone. The subject property is a
standard rectangular lot, 25Ix117.51, and does not
exhibit any unique topography or surroundings
distinct from every other lot in the vicinity and
RHO zone.
3. The granting of Variance 6-87 would constitute a
grant of special privileges due to the absence of
unusual circumstances justifying approval.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of
the City of Seal Beach does hereby deny Variance 6-87.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the
City of Seal Beach at a meeting thereof held on the 5th day of
August, 1987, by the following vote:
