A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF SEAL BEACH APPROVING
CONDITIONAL USE PERMIT 5-87, A REQUEST
TO TRANSFER AN ON-SALE AND OFF-SALE BEER
AND WINE LICENSE TO THE NEW OWNER OF AN
EXISTING RESTAURANT/DELI
(143 MAIN STREET, SEAL BEACH, CA)
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
WHEREAS, on April 9, 1987, Connie M. Schuman submitted an
application for Conditional Use Permit 5-87 to the
Department of Development Services; and
WHEREAS, the applicant is requesting the transfer of the on-sale
beer and wine license, and to continue off-sale beer
and wine operations at the Old Town Wine and Gourmet
Deli, 143 Main Street; and
WHEREAS, the subject property contains 2937.5 square feet, with
25 feet of frontage on Main Street; and
WHEREAS, the surrounding land uses and zoning are as follows:
North, South and West - Commercial uses in the C-l
(Service Commercial) zone.
East - Grace Community Church; and
WHEREAS, the applicant proposes to maintain the existing
restaurant/deli as is for the present, with a possible
remodel of the cooking school/wine tasting room for
additional seating; and
WHEREAS, the proposed hours of operation are 10:00 a.m. to 12:00
midnight, Monday through Friday and 11:00 a.m. to
12:00 midnight, Saturday and Sunday; and
WHEREAS, on January 16, 1985, the Planning Commission adopted
Resolution Number 1355 approving Conditional Use Permit
19-84 for on-sale beer and wine at 143 Main Street, and
allowing off-sale beer and wine to continue as
operated; and
WHEREAS, in January, 1985, the Planning Commission likewise
approved Variance 15-84 and CUP 22-84 allowing the
subject property to deviate from the required parking,
and authorizing a take-out restaurant on the site; and
WHEREAS, Stacy T. Picascia, Chief of POlice, has reviewed
existing records and has no reservations about
permitting this transfer; and
WHEREAS, a duly noticed public hearing was held on May 20, 1987
at which time the Planning commission approved CUP 5-87
subject to ten (10) conditions; and
WHEREAS, one condi tion of approval was that the term of the
permit would be for one (1) year, after which time the
Planning commission could extend the CUP indefinitely;
and
WHEREAS, a duly noticed public hearing was held on Wednesday,
May 18, 1988.

NOW, THEREFORE, BE IT RESOLVED that the Planning commission of
the City of Seal Beach does hereby approve Conditional Use Permit
5-8, subject to the following conditions:
1. CUP 5-87 is approved for on-sale and off-sale beer and
wine at 143 Main Street, and is issued to Connie M.
Schuman.
2. All alcoholic beverages sold in conjunction with the
restaurant operation shall be consumed entirely within
the restaurant portion of the building.
3. No video games of similar amusements shall be permitted
on the premises.
4. There shall be no alcoholic beverages advertising
in the window areas. All existing alcoholic beverage
advertising shall be removed.
5. The applicant shall comply with all restrictions placed
on the ABC license by the California Department of
Alcoholic Beverage Control.
6. CUP 5-87 is non-transferable.
7. Approval of CUP 5-87 is subject to all conditions
established for Variance 15-84 and CUP 22-84.
8. Any plans to expand the restaurant area shall be
presented to the Planning commission as an amendment to
Variance 15-84.
9. With the applicant's consent, hours of operation shall
be from 9:00 a.m. to 12:00 midnight, Monday through
Saturday, and 10:00 a.m. to 12:00 midnight, Sunday.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the
City of Seal Beach at a meeting thereof held on the 18th day of
May, 1988, by the following vote:
