HomeMy WebLinkAboutPC Res 1460 - 1987-05-06 " . t . e RESOLUTION NUMBER 1460 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING CONDITIONAL USE PERMIT 2-87, A REQUEST TO UPGRADE AN EXISTING ON-SALE BEER AND WINE LICENSE TO AN ON-SALE GENERAL LICENSE THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, on April 1, 1987, Beach, submitted Permit 2-87 to the and Jack Haley, 404 Ocean Avenue, Seal an application for Conditional Use Department of Development Services;. WHEREAS, the applicant is requesting to upgrade the existing on- sale beer and wine license for that location to an on- sale general license; and the subject property is a rectangular parcel measuring 50' x 110', located at the northeast corner of Ocean Avenue and Main Street; and the surrounding land uses and zoning are as follows: WHEREAS, 1 ~~ <JQ c-.... AS, WHEREAS, North and West A mixture of offices, commercial retail, commercial services and multi-family residential uses in the C-1 (Service Commercial) zone. East - Commercial retail businesses in the C-1 (Service Commercial) zone. South - Eisenhower Park, the Municipal Pier and the beach located in the PLU (Public Land Use) zone; and the subject property contains a restaurant of 1,831 square feet with eight (8) on-site parking spaces and eleven (11) in-lieu spaces; and WHEREAS, on November 5, Resolution Number by Jack Haley restaurant on the 1986, the Planning Commission adopted 1439 approving on-sale beer and wine in conjunction with the existing subject property; and WHEREAS, the applicant is currently proposing an expansion of the enclosed dining area, and an overall remodel has been completed, converting the cafe-style restaurant to a nautical-theme dinner house; and WHEREAS, the above-mentioned remodel provides a lounge/dining area with 9 bar seats and approximately 15 table seats, and a dining area with 46 seats; and WHEREAS, the enclosure of outdoor dining area proposed under Variance 3-87 provides a better controlled environment for the service of alcoholic beverages; and WHEREAS, Chief of Police Stacy Picascia has reviewed existing records and has no reservations regarding the approval of this conditional use permit; and WHEREAS, a duly noticed public hearing was held on May 6, 1987; and WHEREAS, the Planning Commission finds that this request is compatible with the surrounding land uses and the type of business proposed. 1 . . ; Resolution Number 1460 Page 2 NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Conditional Use Permit 2-87, subject to the following conditions: 1. CUP 2-87 is approved for on-sale beer, wine and distilled spirits at 901 Ocean Avenue, and is issued to Jack Haley. 2. CUP 2-87 is non-transferable. 3. CUP 2-87 shall be automatically terminated if the operation is no longer maintained as a "bona fide public eating place" as defined by the State Department of Alcoholic Beverage Control. 4. All alcoholic beverages sold shall be consumed entirely on the premises. 5. All alcoholic beverages sold shall be served by hand within the premises. 6. No alcoholic beverage advertising or display devices shall be located in the window areas or outside the restaurant. 7. Hours of operation shall be from 6:30 a.m. to 11:00 p.m., Sunday through Thursday, and 6:30 a.m. to 12:00 a.m., Friday and Saturday. The kitchen shall close at 10:00 p.m., Sunday through Thursday, and at 11:00 p.m., Friday and Saturday. 8. The full menu shall be served at every seat within the premises. 9. At such time as the kitchen may close, the dining rooms shall also close, and the service of alcoholic beverages shall be limited to the 24-seat lounge area. Customers seated in the dining area and awaiting service may be served and may complete their meals. 10. The applicant shall comply with all restrictions placed on his license by the State Department of Alcoholic Beverage Control. 11. Approval of CUP 2-87 is subject to all conditions attached to Variance 3-87. 12. The term of this after which time and may extend the all conditions of significant police permit shall be twelve (12) months, the Planning Commission will review permit indefinitely provided that approval have been satisfied, and no problems have occurred.
