RESOLUTION NUMBER 1459
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF SEAL BEACH APPROVING VARIANCE 3-87, A REQUEST TO
PERMIT STRUCTURAL MODIFICATIONS TO A NON-CONFORMING,
NON-RESIDENTIAL USE (901 OCEAN AVENUE)
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
WHEREAS, on March 27, 1987, Jack Haley, 404 Ocean Avenue, Seal
Beach, submitted an application for Variance 3-87 to
the Department of Development Services; and
WHEREAS, the applicant is requesting permission to enclose a
portion of the existing restaurant at 901 Ocean Avenue;
and
WHEREAS, the subject property is a rectangular parcel measuring
50' x 110', located at the northeast corner of Ocean
Avenue and Main Street; and
WHEREAS, Main Street and Ocean Avenue are primary streets
developed to their ultimate master planned width of 80
feet, with a signalized intersection; and
WHEREAS, the subject property contains a restaurant of 1,831
square feet with eight (8) on-site parking spaces and
eleven (11) in-lieu spaces; and
WHEREAS, the applicant proposes to enclose an additional 212
square feet of floor area at the southwest corner of
the existing restaurant. The plans submitted indicate
that fourteen (14) seats will be provided in this area;
and
WHEREAS,

the City's parking requirements.

NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of
the City of Seal Beach does hereby approve Variance 3-87, subject
to the following conditions:
1. The applicant/property owner shall agree to participate
in such in-lieu parking program as has been or shall be
established by the City Council for the amount equal to
thirteen (13) spaces. Any changes to the total parking
requirement for the site shall cause the modification
of the rate of participation in the in-lieu program,
subject to Planning Commission approval.
2. A detailed landscaping and irrigation plan which
provides landscaping of the equivalent of 10% of the
site area shall be submitted to the Director of
Development Services and approved prior to the issuance
of a Certificate of Occupancy.
3. The parking area shall be graded, resurfaced and
striped for eight standard parking spaces. The parking
area shall be maintained for the use of restaurant
employees and patrons.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the
City of Seal Beach at a meeting thereof held on the 6th day of
May, 1987, by the following vote:
