RESOLUTION NUMBER 1449
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF SEAL BEACH APPROVING VARIANCE 1-87, A REQUEST TO
PERMIT A 25 FOOT CURB CUT ON MARINA DRIVE TO ALLOW
ACCESS TO SIX ENCLOSED PARKING SPACES (229 4TH STREET)
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
WHEREAS,
on January 26, 1987, Frances

WHEREAS, the applicant is requesting a 25 foot curb cut for the
property on the southwest corner of Marina Drive and
Fourth Street, the curb cut to be made along Marina
Drive, to allow access to six enclosed parking spaces;
and

WHEREAS, the subject property is an irregularly shaped lot
containing approximately 7,428 square feet, with 98.61
feet of frontage on Fourth Street, 137.18 feet of
frontage on Marina Drive, and 27.82 feet of frontage on
the Third Street alley; and
WHEREAS, the applicant proposes to develop the subject property
with three two-story town homes, each with a 400 square
foot two-car garage with access from the requested curb
cut; and
WHEREAS, Section 28-2502 of the Municipal Code requires that the
Planning Commission make the following findings before
any variance can be granted:
(1) Such variance shall not adversely affect the
General Plan;
(2) Because of special circumstances applicable to the
property, including size, shape, topography,
location or surroundings, the strict application
of this chapter deprives such property of
privileges enjoyed by other property in the same
vicinity and zone;
(3) The granting of such variance shall not constitute
a grant of special privilege inconsistent with
other limitations upon other properties in the
same vicinity and zone. (Ord. No. 948.); and
WHEREAS, the Planning Commission makes the following findings:
1. Variance 1-87 will not adversely affect the General
Plan as the curb cut requested by Variance 1-87 is
associated with the development of three dwelling units
at 229 4th Street, in conformance with the General Plan
and zoning designations for the property.
2. There exist special circumstances related to the shape
of the property which deprive' 229 4th Street of the
privileges otherwise associated with the RHO zone,
namely that the irregular shape of the property and the
unusually short rear property line prevent the
construction of the parking garages in an open form
accessible from the rear alley without foregoing the
opportunity to develop on the rear half of the
property.

3. The granting of Variance 1-87 is not a grant of special
privilege as the Planning Commission has approved
variances related to providing more efficient parking
configurations on irregular lots in the past.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission does
hereby approve Variance 1-87 subject to the following conditions:
1. Development shall be in substantial compliance with the site
plan submitted as part of this application (Exhibit A).
2. No parking shall be permitted in the 24 foot drive aisle,
and signs shall be posted stating this restriction.
3. A six inch high concrete curb shall be placed at the end of
the drive aisle to prevent parking and driving in the side
yard and open space.
4. All sidewalks, curbs and gutters shall be reconstructed to
the satisfaction of the City Engineer.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the
City of Seal Beach at a meeting thereof held on the 4th day of
March, 1987 by the following vote:
