AMENDED RESOLUTION NUMBER 1457
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF SEAL BEACH APPROVING
CONDITIONAL USE PERMIT 4-87, A REQUEST
TO PERMIT THE TRANSFER OF AN ON-SALE
BEER AND WINE LICENSE TO THE NEW OWNERS
OF AN EXISTING RESTAURANT
(500 PACIFIC COAST HIGHWAY, 1104)
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DO,ES HEREBY
RESOLVE:
WHEREAS, on April 8, 1987, Soong H. Kim and Song K. Kim
submitted an application for Conditional 'Use Permit
4-87 to the Department of Development Services; and
WHEREAS, the applicant is requesting the transfer of the on-
sale beer and wine license at Norm Calvinls, 500
Pacific Coast Highway, 1104, as the new owner of the
restaurant; and
WHEREAS. the subject property is the Bay City Center, a
multiple-tenant center at the southeast corner of 5th
Street and Pacific Coast Highway; and
WHEREAS, the surrounding land uses and zoning are as follows:
North -
Single family homes across Pacific Coast
Highway in the Residential Low Density zone
( RL D) .
A mix of commercial and residential uses. and
a church. in the C-1 (Service Commercial)
C - 2 ( G e n era 1 Co mm e r cia 1) and R H D (R e sid en t i a 1
High Density) zones.
The Raddison Hotel and a mix of commercial
uses in the C-2 (General Commercial) zone.
Single family homes in the Bridgeport Planned
Unit Development; and
WHEREAS, the applicant proposes to maintain the existing
restaurant as is, encompassing 1,445 square feet with
521 square feet devoted to food preparation. The
menu and hours of operation would also remain the same;
and

WHEREAS. on August 1. 1984. the Planning Commission adopted
Resolution Number 1333 approving Conditional Use
Permit 12-84 for on-sale beer and wine at Norm
Calvin's. Seven conditions were attached to CUP 12-84

1. CUP 12-84 is approved for on-sale beer and wine at
500 Pacific Coast Highway. Suite 1104. and issued
to Blest, Inc./Norm Calvin. President.
2. That all alcoholic beverages shall be consumed
entirely within the building.
3. That the applicant shall comply with all
restrictions placed on the ABC license by the
State Department of Alcoholic Beverage Control.
4. There shall be no alcoholic beverages advertising
display devices located in the window areas.

CUP 12-84 is non-transferable.
CUP 12-84 to be reviewed by staff at the end of
one year.

No sale of alcoholic beverages after 11:00 p.m..
WHEREAS, on September 18, 1985, the Planning Commission
reviewed CUP 12-84 and extended it indefinitely. At
that time, the Commission also approved the applicant's
request to extend the hours for sale of alcoholic
beverages until 1 :30 a.m.; and
WHEREAS, Stacy T. Picascia, Chief of Police, reviewed the
existing records and had no reservations about
permitting this transfer; and
WHEREAS, a duly noticed public hearing was held on Wednesday,
May 6, 1987, at which time the Planning Commission
approved CUP 4-87 subject to eight conditions; and

Planning Commission could extend the CUP indefinitely;
and
WHEREAS, a duly noticed public hearing was held on Wednesday,
May 2, 1988; and
WHEREAS, the Planning Commission finds that the request is
compatible with the surrounding land uses, the
commun ity in general, and the General P1 an.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of
the City of Seal Beach does hereby approve Conditional Use Permit
4-87 subject to the following conditions:
1. CUP 4-87 is approved for on-sale beer and wine at
500 Pacific Coast Highway, 1104, and is issued to
Soong H. Kim and Song K. Kim.
2. All alcoholic beverages shall be consumed entirely
within the building.
3. No video games or similar amusements shall be permitted
in conjunction with the restaurant use.
4. There shall be no alcoholic beverages advertising in
the window areas.
5. The appl icant shall comply with all restrictions
placed on the ABC license by the California Department
of Alcoholic Beverage Control.
6. CUP 4-87 is non-transferable.
7. No alcoholic beverages shall be sold after 11:00 p.m.

PASSED, APPROVED AND ADOPTED by the Planning Commission of the
City of Seal Beach at a meeting thereof held on the 18th day of
May, 1988, by the following vote:
