11 3. Review of document and provision of comments – Draft Mitigated Negative
12 Declaration 08-2, East Beach Sand Nourishment Project.

Recommendation:
14 Receive presentation from Staff regarding the proposed
15 project and the environmental review process. Receive comments from the
16 public and provide any Board Member comments regarding proposed Mitigated
17 Negative Declaration 08-2 (MND 08-2). Receive and File Staff Report.

21 Mr. Olivera delivered the staff report. (Staff Report is on file for inspection in the
22 Planning Department.) He provided some background information on this item and
23 noted that a copy of the draft report for MND 08-2 was provided to the Board Members
24 at the previous meeting of June 25, 2008, and tonight’s meeting was scheduled in order
25 to receive the Board’s comments or concerns. He explained that this is a federal sand
26 nourishment project that occurs approximately every 4-6 years to replenish sand on the
27 beach that is depleted due to the construction of the Navy jetties at Anaheim Bay, the
28 federal breakwater in Long Beach, and the channelization of the San Gabriel/Los
29 Angeles rivers.

31 Board Comments

33 Chairperson Voce expressed his concern with the dredging of sand from the river,
34 which could disrupt and release toxins from the river bottom, and then depositing this
35 contaminated sand onto the beach. He noted that there really is no way of “treating”
36 this sand prior to transferring it. He then commented on the effects to air quality by toxic
37 fumes released from the sand into the air during this process, as well as particulate
38 matter from the equipment used for this project. He also noted that during the rainy
39 season bacteria and heavy metal content can be released from the replenished sand.

41 Member Barton asked who pays the cost of this type of project. Mr. Olivera explained
42 that this is a federally-funded project, but in approximately the 1950s the City of Seal
43 Beach took on the responsibility for maintaining the main beach area. He added that
44 Surfside is still under the federally-funded program.

1 Member Hurley stated that it would facilitate reading the document if Section 5 were
2 subdivided, using separate titles listing the various environmental factors discussed. He
3 then made the following recommendations for changes to the document:

5 1. Pg. 1-1 - Heading for Section 1.3 should read “Initial Study Mitigated Negative
6 Declaration Approval,” as the approval of the project is discussed in
7 Section 3.3.

9 2. Pg. 4-5 - More than one checkbox at the top of the page for environmental factors
10 should have been checked.

12 3. Pg. 4-19 - Add the word “continued” at the bottom of the page so the reader will
13 know this statement continues on the next page.

15 4. Pg. 5-30
16 & 5-31 Discussion on “Construction-Related Noise Impacts” is faulty, as
th
17 residences near 13 Street would experience impacts of approximately
18 81 or 82 dBAs, not 77. There should be a comparison between the
19 existing noise and the noise added by the construction-related activities,
20 as this would reflect the cumulative level of noise levels experienced by
21 residents.

23 5. Pg. 5-30 Do the sound levels shown in Table 6 include mitigation measures?
24 Noise reduction levels provided by mitigation measure should be shown.

26 6. Pg. 3-2 It would be helpful to include a less technical summary statement, such
27 as, “As indicated, the beach will be widened by 250 feet at its present
28 narrowest point and proportionately elsewhere.” The aerial photograph
29 provided is not very clear.

31 Member Hurley then commented that City policy covering this subject is not mentioned
32 and should be discussed in the MND.
