HomeMy WebLinkAboutPC Res 1455 Amend - 1988-03-16 . , RESOLUTION NUMBER 1455 (AMENDED) A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING CONDITIONAL USE PERMIT 1-87, A REQUEST TO ESTABLISH THE ANCILLARY SERVICES TO BE PERMITTED IN CONJUNCTION WITH AN EXISTING HOTEL USE (212 FIFTH STREET) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, on January 12, 1987, the Seal Beach City Council adopted Ordinance Number 1238 establishing hotels as a permitted use in the C-2 zone, and as a conditionally permitted use in the RHD zone when lawfully existing on January 1, 1987, and a conditional use permit is granted on or before January 1, 1988; and WHEREAS, on February 11, 1987, Marjorie Bettenahusen submitted an application for Conditional Use Permit 1-87; and WHEREAS, the applicant is requesting the Planning Commission to determine the ancillary services to be permitted in conjunction with the existing hotel use. Specifically, the applicant has proposed the following: a. Outdoor gatherings for not more than one hundred (100) persons, provided that valet parking service and at least fifty (50) off-site parking spaces are provided. Food and drink may be served. Amplified music shall be prohibited. b. Indoor gatherings for not more than thirty (30) persons, provided that at least 10 off-site parking spaces are provided. Food and drink may be served. c. Visits to the Inn by travel agents and others for promotional purposes. Food and drink may be s e r v ed . d. Food service for hotel guests. e. Sale of flowers and sundries to guests and visitors. f. Alcoholic beverages shall not be served; and WHEREAS, the subject property is a rectangular parcel containing approximately 17,625 square feet, with 150 feet of frontage on Fifth Street and 117.5 feet of frontage on Central Avenue; and WHEREAS, the surrounding land uses and zoning, on all sides, are a conforming and non-conforming mixture of single and multiple family dwellings in the RHD (Residential High Density) zone; and WHEREAS, a duly noticed public hearing was held on March 18, 1987, at which time the Planning Commission approved CUP 1-87 subject to fifteen (15) conditions; and WHEREAS, one condition of approval was that the term of CUP 1-87 wo u 1 d be for 0 n e (1) yea r, aft e r w h i c h t i met h e Planning Commission could extend the permit i n de fin it e 1 y pro v i d ed t hat a 11 co n d i t ion s 0 f a p pro val had been satisfied; and - . pag e 2 Resolution 1455 (Amended) WHEREAS, the Planning Commission held a duly noticed public hearing on Wednesday, March 16, 1988, to consider the extension of CUP 1-87; and WHEREAS, the Planning Commission makes the following findings: 1. With appropriate conditions attached, approval of this request will not adversely affect the surrounding neighborhood. 2. The proposed uses will not adversely affect the General Plan or the community in general. 3. All conditions of approval imposed on March 18, 1987 have been satisfied. NOW, THE REF 0 R E, BEl T RES 0 LV EDt hat the P 1 ann i n g Co mm i s s ion 0 f the City of Seal Beach does hereby approve Conditional Use Permit 1-87 subject to the following conditions: 1. Ancillary services offered by the Seal Beach Inn shall be limited to the following: a. Food service for hotel guests, and hors d'oeuvres and non-alcoholic drinks for special events. b. Indoor gatherings for not more than thirty (30) persons. c. Outdoor gatherings for not more than one hundred (100) persons. d. Visits to the Inn by travel agents and other for promotional or community purposes. 2. Outdoor gatherings at the Inn shall take place between th.e hours of 10:00 a.m. and 8:00 p.m.. 3. Outdoor gatherings shall be limited to four (4) per month. 4. There shall be no amplification equipment used in conjunction with gatherings or events. 5. Food preparation services shall be provided for guests and special events only; the Inn shall not extend catering service to the general public. 6. Neither this Conditional Use Permit, nor any future CUP, shall be granted to approve the service of alcoholic beverages by the Seal Beach Inn. 7. The Inn shall maintain a minimum of forty (40) off-site parking spaces. Evidence of these spaces, in the form of written agreements, shall be provided to the City annually. 8. Events shall take place only at such times when, as shown by written agreements, parking is available on or off-site at a rate of one (I) space for each three (3) guests. 9. Valets may be used to assist with patron parking in lots within 800 feet of the Inn. Shuttle service shall be provided when lots greater than 800 feet away are utilized. 10. Bus parking, when necessary, shall be provided in contract lots only. All loading and unloading of buses shall take . , Page 3 Resolution 1455 (Amended) 11. The on-site parking area shall be maintained exclusively for vehicle parking. No events shall take place in the on- site parking area. 12. The sole exception to Condition 11 shall be wedding ceremonies, which shall be subject to all other conditions listed herein. Immediately upon the conclusion of a wedding ceremony, the courtyard area shall be cleared and reverted to parking area. Use of the on-site parking area for wedding ceremonies all be limited to the hours of 10:00 a.m. to 3:00 p.m.. 13. The number of guest room at the Inn shall be limited to twenty-three (23). 14. The Fire Department shall inspect the pool area for occupancy load and exits, and shall make recommendations regarding exiting from the pool area.
