RESOLUTION NUMBER 1483
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF SEAL BEACH APPROVING
CONDITIONAL USE PERMIT 11-87, A REQUEST
TO TRANSFER AN ON-SALE BEER AND WINE
LICENSE TO THE NEW OWNER OF AN EXISTING
RESTAURANT/DELICATESSEN (2938 WESTMINSTER
AVENUE).
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:

on October 13, 1987, Juliet B. Vidanes submitted an
application for Conditional Use Permit 11-87 tot h e
Seal Beach Department of Development Services; and
the applicant is requesting approval of the transfer of
an on-sale beer and wine license in conjunction with an
existing restaurant/delicatessen use located at 2938
Westminster Avenue, Seal Beach, CA; and
the subj ect property is located in the First Federal
Plaza, a multiple-tenant center located at the
southwest corner of the intersection of Seal Beach
Boulevard and Westminster Avenue; and
the surrounding land uses and zoning are as follows:
NORTH - A mix of commercial and residential uses in
the C-l (Service Commercial), C-2 (General
Commercial) and RHD (Residential High Density) zones;
SOUTH and EAST - Land belonging to the United States
Naval Weapons Station in the PLU (Public Land Use)
zone;
WEST - Light manufacturing in the M-l (Light
Manufacturi ng) zone; and
WHEREAS, the applicants are proposing to maintain the
restaurant/delicatessen as is, making only cosmetic
improvements; and
WHEREAS, the proposed hours of operation are:
Monday - Friday
Saturday
Sunday
9:00 a.m. to 7:00 p.m.
9:00 a.m. to 6:00 p.m.
Closed; and

Resolution Number 1221 approving Conditional Use Permit
1-81 for on-sale beer and wine at 2938 Westminster
Avenue. Three conditions were attached to CUP 1-81 as
follows:
A. CUP for on-sale beer and wine only at 2938
Westminster Avenue;
B. CUP issued is non-transferrable;
C. CUP is issued for a period of one year; renewal
at the end of one year with Commission approval;

WHEREAS, William Stearns, Chief of Police, has reviewed the
existing records and has no reservations about
permitting the operation to commence.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of
the City of Seal Beach does hereby approve Conditional Use Permit
11-87, subject to the following conditions:
1. CUP 11-87 is approved for on-sale beer and wine at
2938 Westminster Avenue and is issued to Juliet B.
Vidanes. This CUP is non-transferrable.
2. All alcoholic beverages shall be consumed entirely
within the building, and none shall be sold as take
out.
3. No video games or similar amusements shall be
permitted on the premises.
4. There shall be no alcoholic beverages advertising
in the window area.
5. The applicant shall comply with all restrictions
placed on the ABC license by the California Department
of Alcoholic Beverage Control.
6. CUP 9-87 shall be automatically terminated if the
operation is no longer maintained as a "bona fide
public eating place" as defined by the State Department
of Alcoholic Beverage Control.
7. CUP 11-87 shall be granted for one year, after
which time the Planning Commission shall review the CUP
and may extend it indefinitely.
8. With the applicant's consent, hours of operation
shall be from 9:00 a.m. to 7:00 p.m., Monday through
Friday, and 9:00 a.m. to 6:00 p.m., Saturday and closed
on Sunday.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the
City of Seal Beach at a meeting thereof held on the 18th day of
November, 1987, by the following vote:
