YARD SETBACK AND THE 3-FOOT REAR YARD SETBACK AT B-114 SURFS I DE THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH HEREBY RESOLVES: WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, an application was duly filed by Donald and Myrna Jacobson, 10402 El Dorado, Los Alamitos for Variance, V-7-83; and the property is described as, Lot 114, Block B, Surfside Colony and is more commonly known as B-114 Surfside; and the proposal is to permit a house to occupy a portion of a three foot side yard and three foot rear yard; and the Planning Commission on August 17, 1983 adopted Resolution 1300 denying a Variance request by the applicant for encroachment of a three foot side yard for this property; and the Planning Commission on December 7, 1983 held a public hearing on Variance request V-7-83; and the Planning Commission makes the following findings; 1. The building plans were prepared and building was built without consulting record maps, records of survey, or surveying the lot. 2. The building was constructed improperly on the lot so that a portion of the building was constructed over the property line. 3. The plans for relocating the house on" the lot were prepared without simple engineering/ geometric calculations to determine if the house would fit on the lot and meet all set- backs. 4. All "hardship" with this application was created by applicant. 5. No hardship as defined by code exists with this application. NOW, THEREFORE BE IT RESOLVED that the Planning Commission does hereby deny variance, V-7-83.
