RESOLUTION NUMBER 1308 A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION APPROVING VARIANCE APPLICATION 8-83 FOR SEAPORT IMPORTS, 1244 AND 1250 PACIFIC COAST HIGHWAY THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH HEREBY RESOLVES: WHEREAS, an application was duly filed by Allen L. Voda, 1250 Pacific Coast Highway, Seal Beach, CA 90740 for Variance 8-83, Seaport Imports; and WHEREAS, the property is described as, Lots 67 and 69 of the Bay View Tract, a subdivision of a portion of Blocks E and F, Bay City, a map of which is recorded in Miscellaneous Map Book 3, Page 19, filed in the office of the Recorder, Orange County, California; and WHEREAS, the Planning Commission on December 21, 1983, held a Public Hearing on Variance 8-83 and then denied the application without prejudice, and instructed the applicant to discuss alternatives with staff and to make changes in the proposal; and WHEREAS, the modified proposal is to convert an existing two-story office building containing 3,872 square feet and an exist- ing one-story 1,550 square foot auto service building, along with the construction of a 353 square foot one-story addition so as to develop an auto sales and service facility; and WHEREAS, Al Voda proposed the adoption of Variance 8-83 a request to deviate from the required drive aisle width and provision of landscaping; and WHEREAS, the Planning Commission on February 1, 1984 held a Public Hearing on resubmitted Variance application V-8-83; and WHEREAS, the Planning Commission makes the following findings regarding the Variance: 1. The proposed drive aisle width is necessary to physically accommodate parking between the two existing structures. 2. The applicant's proposed increase of parking stall widths; 1 foot in space width for each 1 foot in aisle depth less than the required 24 foot drive aisle width, will provide the turning radius equivalent equal to as intended by the City's drive aisle width requirement. 3. The Variance shall not adversely affect the General Plan because the use is consistent with the General Plan. 4. Hardship is involved in this application due to the physical location of existing structures and the condition and size of the site. 5. The granting of this Variance does not constitute a grant of special privilege inconsistent with other limitations upon other properties in the same vicinity and zone. 6. The project includes additional trees which exceeds the code-required number of trees per parking spaces. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission does hereby approve Variance Application, V-8-83 subject to the following conditions: 1) That all lighting be so directed to prevent direct glare of illumination onto adjacent properties. 2) That a detailed landscape and irrigation plan to approved by the Principal Planner, which provides landscaping of up to 10% of the site area (1,000 square feet) or as mutually determined by the applicant and City staff. .. . . RESOLUTION NUMBER 1308 Page 2 The landscape plan to note the type of trees (5 gallon can minimum) and depict the plant materials proposed. In addition, t~e plan must specify the design and location of the irrigation system required for maintenance of the land- scape. Also, the landscape plan to provide that concrete curbing or other separation material surround the landscape area. 3) That perimeter fencing or wall concept be uniform in design. The-design and location to be approved by the Principal Planner. 4) The top poles and barbed wire be removed from the perimeter fencing and walls. 5) That wood slats be placed within the chain link gates. 6) That use of valet parking to be limited to this particular application for a Mercedes-Benz sales and service facility. Valet parking service to be provided during all open hours. 7) That new curbing and sidewalk be provided at the location of the old curb cut on 13th Street. 8) That the off-street parking situation be reviewed in one year, additional parking may be required at that time. 9) That parking and access facilities for the handicapped be provided as required by the California Access Laws. Specific- ally, parking space number 13 be marked for handicapped and space number 8 be redesigned as a standard 9' X 20' space. 10) That the development be in accordance with the site plan as approved by the Planning Commission or as modified by the above conditions. The revised plan to be submitted to the Principal Planner for approval. NOW, THEREFORE, be it resolved that the Planning Commission does hereby approve Variance, V-8-83. PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meeting thereof held on the 15th day of February 1984 by the following vote: AYES: NOES: ABSENT: Commissioners Jessner, Murphy, Covington, Goldenberg Commissioners None Commissioners Perrin C~1a~
