RESOLUTION NUMBER 1309 A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION APPROVING CONDITIONAL USE PERMIT, CUP 1-84, FOR ON-SALE BEER AND WINE LICENSE FOR LE PALAIS' OR (SWISS BAKERY) AT 500 PACIFIC COAST HIGHWAY, SUITE 110 (BAY CITY CENTER) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH HEREBY RESOLVES: WHEREAS, an application was duly filed by Karl and Dianne Boerner, 500 Pacific Coast Highway, Suite 110; for CUP 1-84; and WHEREAS, the property is located in the Bay City Center at 500 Pacific Coast Highway, Suite 110; and WHEREAS, the property is described as, Parcell, in the City of Seal Beach, County of Orange, State of California, as shown on a parcel map filed in Book 119, Page 42 of parcel maps in the office of the County Recorder of said County; and WHEREAS, the proposal is for a Conditional Use Permit'to allow on-sale beer and wine in conjunction with the existing Le Palais' Or Bakery at 500 Pacific Coast Highway, Suite 110; and WHEREAS, past operations of the existing bakery have been compatible with surrounding land uses; and NOW, THEREFORE BE IT RESOLVED that the Planning Commission does hereby approve CUP 1-84 subject to the following conditions: 1. CUP is approved for on-sale beer and wine at 500 Pacific Coast Highway and issued to Karl and Diane Boerner. 2. That all alcoholic beverages shall be consumed entirely within the building with the minor exception of incidental sales of packed picnic basketswixh prepackaged beer and wine. 3. That the applicant shall comply with all restrictions placed on his license by the State Department of Alcoholic Beverage Control. 4. CUP issued is non-transferable. 5. There shall be no alcoholic beverage advertising display devices located in the window areas. 6. To be reviewed by staff at the end of one year. 7. No sale of alcoholic beverages after 10:00 p.m. PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meeting thereof held on the 15th day of February , 1984 by the following vote: AYES: NOES: ABSENT: Commissioners Jessner, Murphy, Covington, Goldenberg None Commissioners Commissioners Perrin
