RESOLUTION NUMBER 1313 A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION DENYING VARIANCE APPLICATION 2-84 A REQUEST TO EXCEED THE MAXIMUM TOTAL SQUARE FOOTAGE OF SIGNAGE (12800 SEAL BEACH BLVD.) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH HEREBY RESOLVES: WHEREAS, an application was duly filed by the Atlantic Richfield Company, 300 W. Glenoaks, Blvd., Glendale, CA 91202; and WHEREAS, the property is described as, Parcel 1 in the City of Seal Beach, county of Orange, state of California, as shown on a map recorded in Book 15, Page 11 of Parcel Maps, in the office of the county recorder of said county; and WHEREAS, the proposal is to exceed the maximum total square footage of signage (Code Section 28-1810); and WHEREAS, the subject property contains approximately .71 acres and located at southeasterly corner of Seal Beach-Los Alamitos Blvd. and Lampson Avenue. (12800 Seal Beach Blvd.): and WHEREAS, the subject property fronts Seal Beach Blvd. and Lampson Avenue which are noted as local scenic roadways in the General Plan; and WHEREAS, the buildings on subject property are of a rustic type (wood frame) New England Colonialt desi.g.n, painted wh';"te, with shake shingle roofing and that the pump islands canopies are of New England covered "wooden bridge" design, also painted white with shake shingle roofing; and WHEREAS, Section 28-271.1 of the Seal Beach Zoning Code defines a sign as: "any medium device or structure used for visual communication or attraction, including any display, illustration, insignia, model, statue or symbol used to identify a place or to advertise or promote the interest of any person; together with the framework, background material, structure and component parts. Painted signs and super graphics are signs"; and WHEREAS, the applicant proposes a signage program using internally illuminated and unilluminated facia super graphic panels, spandrel panels, pump topper signs, dispenser signs, for the existing service station building and canopy and island areas totaling 1,083 square feet of signage; and WHEREAS, Section 1810 of the Seal Beach Municipal Code specifically states that all signs except self-service, full service information sign for auto service stations shall not exceed 150 total square feet; and WHEREAS, the Planning Commission makes the following findings regarding the variance: 1. The proposal violates and would have an adverse affect on goals, objectives, policies and text of the Land Use and Scenic Highway Elements of the General Plan. Specifically, the designation of the streets fronting the property as Local Scenic Roadways. 2. That existing signage adequately identifies the premises per Section 28-100 of the Municipal Code. 3. That no special circumstances are applicable to the property that deprives such property of the privileges enjoyed by other property in the same vicinity and zone. 4. That the proposal exceeds the total signage provisions of Sec. 28-1810 by a large magnitude and all hardship is self imposed. . . · RESOLUTION NUMBER 1313. Page 2 5. That the proposal conflicts with the Sec. 28-1800 ..."objectives may best be achieved by limiting the total amount of signing along city streets to an intensity that will adequately identify each premises without being unduly distracting". 6. That the proposal is not consistent or compatible with the architectural style of the existing station, or the surrounding area. NOW, THEREFORE BE IT RESOLVED that the Planning Commission does hereby deny Variance 2-84. PASSED, APPROVED AND ADOPTED by the Planning Commision of the City of Seal Oeach at a meeting thereof held on the 7th day of March , 1984 by the following vote: AYES: Commissioners Murphy, Jessner, Goldenberg NOES: Commissioners None ABSENT: Commissioners Perrin ABSTAIN: Commissioners Commission
