RESOLUTION NUMBER 1314
A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION
APPROVING CONDITIONAL USE PERMIT, CUP 3-84, FOR .
OFF-SALE BEER AND WINE LICENSE FOR MILLER/NAHAS
CONVENIENCE STORE LOCATED TEN ('10) FEET NORTH OF
THE HUNTINGTON BEACH-SEAL BEACH BORDER WITHIN
THE HUNTINGTON HARBOR CHANNEL ADJACENT TO THE
NORTH OF 15922 PACIFIC COAST HIGHWAY, HUNTINGTON
BEACH
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH HEREBY RESOLVES:
WHEREAS, an application was duly filed by Miller/Nahas, 545
Ave. Buenos Aires, San Clemente, CA 92672; and
WHEREAS, the property is located ten (10) feet north of 15922
Pacific Coast Highway, Huntington Beach, within the
City of Seal Beach; and
WHEREAS, the property is described as a parcel of submerged
land in Sunset Bay, Orange County, State of California,
situate adjacent to Tide Land Location No. 141 and
being further described as follows:
Beginning at the terminal point of the last course
recited in that boundary line agreement between the
State of California and the Lincoln Fidelity
Corporation, said agreement being on file with the
State Lands Commission as I'Boundary Line Agreement
No. 46", said last course having a bearing of N.
520 451 00" W. and a length of 850.25 feet; thence
from said point of beginning proceeding into Sunset
Bay N. 370 15' E. 50 feet, S. 520 45' E. 100 feet;
thence S. 370 151 W. 50 feet to the aforementioned
agreed boundary line; thence along said line N. 520
451 W. 100 feet to the point of beginning; contain-
ing 0.115 acre more or less.
WHEREAS,
the proposal is for a Conditional Use Permit to allow
off-sale beer and wine in conuunction with a new fuel
dock and convenience store; and
WHEREAS,
the request is compatible with the surrounding land
use and zoning and will have no adverse impacts on
the co~munity.
NOW, THEREFORE BE IT RESOLVED that the Planning Commission does hereby
approve CUP 3-84 subject to the following conditions:
1. CUP is approved for off-sale beer and wine at the fuel
dock convenience store located 10 feet north of 15922
Pacific Coast Highway, Huntington Beach, and issued to
Miller/Nahas.
2. That the applicant shall comply with all restrictions
placed on his license by the State Department of
Alcoholic Beverage Control.
3. That there shall be no alcoholic oeverage advertising
display devices.
4. To be reviewed by staff at the end of one year.
5. No sale of alcoholic beverages shall occur after 30 minutes
past sunset.
6. That all alcohol sales transactions take place within the store.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the City
of Seal Beach at a meeting thereof held on the 7th day of
March , 1984 by the following vote:
