RESOLUTION NUMBER 1331
A RESOLUTION OF THE SEAL BEACH PLANNING
COMMISSION APPROVING A REQUEST TO ALLOW A
SET OF NON-HABITABLE ARCHITECTURAL FEATURES
TO DEVIATE FROM THE BUILDING HEIGHT LIMITS
IN CONJUNCTION WITH A NEW RESIDENCE (1613 SEAL WAY)
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE:
WHEREAS, an application was duly filed by Peter and Barbara Arnold,
1613 Seal Way, Seal Beach, California 90740; and
WHEREAS, the property is described at Lot 32, Block F of Tract
1 filed in the Office of the Recorder, Orange County,
California; and
WHEREAS, the subject property contains approximately 2,500 sq. ft.
and is located on the north side of Seal Way approximately
186 feet east of the centerline of Neptune Avenue (1613
Seal Way); and
WHEREAS, the subject property has approximately 25 feet of frontage
on Seal Way and a depth of 100 feet; and
WHEREAS, the subject property contains a one story single family
residence without parking; and
WHEREAS, the surrounding land use and zoning are as follows:
North - A legal non-conforming 2-story 10-unit apartment complex
in the R-3 (High Density Residential) Zone.
East - A legal non-conforming 2-story duplex in the R-3 (High
Density Residential) zone.
South - The beach and boardwalk in the PLU (Public Land Use)
zone.
West - A legal non-conforming 2-story duplex in the R-3 (High
Density Residential) zone; and
WHEREAS, on July 22, 1983, the applicant presented Planning staff
with plans of the proposed structure. At that time,
they were "approved in concept"; and"
WHEREAS, the plans were then submitted to the Coastal Commission
which on September 15, 1983 granted a Coastal Development
Permit 5-83-595 allowing demolition of a single family
residence and construction of a new 2,920 sq. ft. residence
with a two-car garage; and
WHEREAS, on January 10, 1984, plans were submitted to the Building
Department and fees paid. Shortly thereafter, the Principal
Planner reviewed the plans and found that a number of
non-habitable architectural features deviated from the
25-foot height limit for lots with less than 37t ft.
of frontage in the R-3 zone; and
WHEREAS, on February 2, 1984, the Planning Commission received
a letter from the applicant concerning this matter; and
WHEREAS, on February 15, 1984, the Planning Commission requested
after review of a survey of other coastal cities that
staff draft a code amendment dealing with architectural
features and exceptions to the building height limits;
and
WHEREAS, on March 7, 1984, staff presented to the Commission such
a code amendment. It was their concensus to accept the
code amendment and bring it back for public hearing in
April, 1984; and

WHEREAS, on April 4, 1984, the Planning Commission held a public
hearing'on Zoning Text Amendment 1-84 (Negative Declaration
3-84) Building Height Limits. At that time, three persons
spoke for the amendment and none in opposition. The
Commission then moved to continue the public hearinB
until the next meeting so the staff can modify the proposed
amendment taking into account the Commission's comments
and the input from the public hearingi and
WHEREAS, on May 2, 1984, the Planning Commission held a public
hearing on the continued item. Staff presented a survey
of exceptions to height limitations of selected coastal
cities and the revised Zoning Text Amendment. Two persons
spoke in favor of the amendment and none in opposition.
Commission then moved to adopt Negative Declaration 4-
84 and Resolution No. 1321 (ZTA 1-84); and
WHEREAS, on May 29, 1984, the City Council held a public hearing
on Zoning Text Amendment 1-84. At that time two persons
spoke for the amendment and none in opposition. The
Council then unanimously moved that Zoning Text Amendment
1-84 be adopted as corrected by the City AttorneYi and
WHEREAS, on June 11, 1984, the City Council unanimously moved
adoption of the second reading of Ordinance 1168 (ZTA
1-84). The Ordinance to become effective July 11, 1984i
and
WHEREAS, the applicant has applied for a Minor Height Deviation
Permit under the soon to-be-effective Ordinance 1168;
and
WHEREAS, the applicant specifically requested the following Minor
Height Deviations described as follows:
North Elevation - A 5 ft. non-habitable parapet not required
by the Uniform Building Code.
South Elevation - 6.75 to 3 ft. non-habitable parapet not required
by the Uniform Building Code. This parapet is also designed
to meet the UBC requirement of a 36" minimum railing around
a roof deck. The tower with spire is designed as a stairwell
up to the roof deck, and therefore within the Building Height
Limit Exception Section 28-2317 (3)0.
West Elevation - 6.75 ft. non-habitable sinBle hip skylight
over an atrium.
East Elevation - 3 ft. non-habitable parapet around the roof
deck and a 6.75 ft. non-habitable single hip covering the end
of the skylighti and
WHEREAS, the proposal is exempt from environmental reviewi and
WHEREAS, on June 20, 1984, the Planning Commission held a public
hearing on Minor Height Variation Permit 1-84i and
WHEREAS, the Planning Commission makes the following findings
regarding the Minor Height Variation:
1. That all height deviations are for non-habitable architectural
features.
2. That the height variations are appropriate for the character
and integrity of the neighborhood.

3. That the height variations are appropriate for the architectural
style of the building.
4. That the height variations do not significantly impair the
primary view from any property located with 300 feet.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of
the City of Seal Beach does hereby approve Minor Height Variation
Permit 1-84 subject to the following conditions:
1. That Building Permits not be issued until July 11, 1984.
2. That all construction be in conformance with the plans as submitted.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the
City of Seal Beach at a meeting thereof held on the 20th day
of June , 1984 by the following vote:
AYES: Commissioners H~nt. Perrin
NOES: Commissioners Goldenberg
ABSENT: Commissioners Covington. Jessner
