RESOLUTION #1343
A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION
APPROVING CONDITIONAL USE PERMIT 16-84 FOR ON-SALE
BEER AND WINE: TOM AND VICKI WINCH, 901 OCEAN AVENUE
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
WHEREAS:. an application was duly filed by Tom and Vicki Winch,
4352 Pickwick Circle, #316, Huntington Beach, California;
and
WHEREAS: the property is located at the northeast corner of Ocean
Avenue and Main Street (901 Ocean Avenue); and
WHEREAS, the proposal is for a Conditional Use Permit to allow
on-sale beer and wine in conjunction with a newly rebuilt
restaurant; and
WHEREAS, the subject property contains approximately 5,500 sq. ft.
and is located at the northeast corner of Ocean Avenue
and Main Street (901 Ocean); and
WHEREAS, the subject property has approximately 50 feet of frontage
on Ocean Avenue and 110 feet of frontage on Main Street;.
and
WHEREAS, the subject property contains a formerly fire-damaged
restaurant containing 1,572 sq. ft. which has been rehabili-
tated and remodeled; and
WHEREAS, the surrounding land use and zoning are as follows:
North and west - a mixture of offices, commercial
retail, commercial services and a
multi-family residence located in
the C-l (Service Commercial) zone.
East - Commercial retail business in the C-l (Service
Commercial) zone.
South - Eisenhower Park, Municipal Pier and beach all
located in the PLU (Public Land Use) zone; and
WHEREAS, that the proposed restaurant is expected to operate with
approximately a 90%/10% ratio of take-out to sit-down
customers (i.e., beach-goers, tourist, local merchants,
nearby residents, etc.); and
WHEREAS, no schools or churches are located within 600 feet; and
WHEREAS, historically the subject location has been used as a
restaurant catering to the beach-going public with take-
out facilities; and
WHEREAS, the request is compatible with the surrounding land use and
zoning and will have no adverse impact on the community; and
NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the
City of Seal Beach does hereby approve Conditional Use Permit 16-84
subject to the following conditions:
1) CUP is approved for on-sale beer and wine at 901
Ocean Avenue and issued to Tom and Vicki Winch.
2) That all alcoholic beverages shall be consumed
entirely within the building aAd enclosed patio area.
3) That the applicant shall comply with all restrictions
placed on his license by the State Department of
Alcoholic Beverage Control.

4) CUP issued is non-transferable.
5) There shall be no alcoholic beverages advertising
display devices located in the window areas.
6) Permit to be reviewed by staff at the end of one
year.
7) No sale of alcoholic beverages after 1:00 a.m.
PASSED, APPROVED AND ADOPTED by"the Planning Commission of the City
of Seal Beach at a meeting thereof held on the 19th day of
September, 1984, by the following vote:
