RESOLUTION NUMBER 1346
A RESOLUTION OF THE CITY OF SEAL BEACH PLANNING COMMISSION
APPROVING VARIANCE APPLICATION 11-84, A REQUEST TO ALLOW
THE CONSTRUCTION OF A TWO-STORY 5,320 SQ. FT. RETAIL
BUILDING WITH LESS THAN THE REQUIRED PARKING (320 MAIN
STREET)
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH HEREBY RESOLVES:
WHEREAS: an application was duly filed by Thomas Schuveiller,
413 Crystal Place, Seal Beach, CA 90740; and
WHEREAS: the subject property is recorded by the recorder of
the County of Orange as Lot 20 and the northeast
19.24 feet of,Lot 18, B]ot~20~"of"Bayview Tract; and
'WHEREAS: the subject property contains a rectangular parcel
of land containing approximately 5,198 square feet
located 185f feet north of the centerline of Electric
Avenue (320 Main Street); and
WHEREAS: the subject property has a total frontage of approxi-
mately 44 feet on Main Street; and
WHEREAS: the subject property is a vacant parcel of land; and
WHEREAS: the surrounding land use and zoning are as follows:
North, south, west - retail and office uses located
in the C-1 (Service Commercial)
zone.
East-a-mixture .of legal nonconforming duplexes and
triplexes, lcoated in the R-3 (High Density
Residential) zone; and
WHEREAS: Main Street is a primary street developed to its master
planned width of 80 feet; and
WHEREAS: that during the period between January 24, 1984 and April
24, 1984, the City Council appointed the Downtown Parktng
and Urban Design Task Force, which met and formulated
recommendations to be considered by the City Council.
These recommendations have been reviewed and approved by
the Planning Commission back in June and City Council
in September. Specifically, the Task Force recommenda-
tions on the parking questions are as follows:
1. "While parking requirements must be eased in order
to encourage the infill of existing vacant lots
and improvements to existing structures, a portion
of the parking spaces must be provided on-site.
City staff should draw up recommended parking
requirements and a method of determining the on-site/
off-site ratio.
2. Some type of in-lieu fee should be established to
help mitigate future parking needs"; and
WHEREAS: staff has been applying a three point policy on parking
requirements in the Main Street area.
1. All new buildings be required additional parking
based upon its intended use, as required by City
code.
2. Occupancy of an usued portion of an existing
building for retail or residential use requires no
additional parking.
3. Replacement uses or an expansion of an existing use
to a more intense use requires additional parking
as stipulated by the City code; and
WHEREAS: the City Council held a study session September 17, 1984
on the recommendations of the Downtown Task Force," and after

a presentation and discussion the Council directed staff
to implement the Task Force recommendationsi and
WHEREAS: the parking study done for the City as part of the Down-
town Revitalization Study by Linscott, Law & Greenspan,
Inc., noted that the 300 block was subject to less
parking demand than the 100 or 200 block of Main Streeti and
WHEREAS: ' on October 3, 1984, the property owner presented plans
and application for a variance requesti and
WHEREAS: the applicant specificallyreq~ested approval to construct
the following on a 5,198 sq. ft. vacant lot.

WHEREAS: the applicant requested to construct a two story retail
building with less than the required parkingi and
WHEREAS: on November 7, 1984, the Planning Commission held a public
hearing on Variance 11-84i and
WHEREAS: the Planning Commission makes the following findings regard-
ing the variance:
1) The variance will not adversely effect the General
Plan.
2) The Downtown Task Force has recommended and the City
Council has directed staff to implement the recommenda-
tion to allow greater flexibility in present parking
requirements, including allowance for on-site/off-site
provisions and in-lieu fee programs.
3) The application falls within the intent of California
Government Code Section 65906.5 on parking variances
which allows for approval of parking variances as noted
in Variance 11-84 if in-lieu fees or other facilities
are provided instead of the on-site parking spaces.
4) The proposal provides as many spaces on site that can
physically be provided in a form consistent with the
design concept of Main Street.
NOW, THEREFORE BE IT RESOLVED that the Planning Commission does hereby
approve Variance 11-84 subject to the following conditions:
1) That the applicant provide in writing an agreement to
participate in an in-lieu parking program or any other
programs the City Council may establish for parking in
the Downtown area to the amount equal to provision of
26 spaces. If the City Council does not establish such
a program, the applicant shall provide a private agree-
ment subject to approval of the City Attorney.

2) That a detailed landscape and irrigation plan which
provides permanent landscaping of up to 10% of the
site area be approved by the Director of Development
Services.
3) That a sign program be designed for all building
signage and approved by the Director of Development
Services.
4) That the lots be consolidated by tentative parcel
map or by merger in accordance with State law.
5) Replace cracked sidewalk, curb and alley approach
to the satisfaction of the City Engineer.
6) Provide up to two street trees to be located in the
parkway to the saitsfaction of the City Engineer.
7) That a covenant be recorded on the title of the
property which stipulates that 31 parking spaces
are required for this development.
