RESOLUTION NUMBER 1330 A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION APPROVING CONDITIONAL USE PERMIT 4-84 AND ADOPTING NEGATIVE DECLARATION 3-84 THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH HEREBY RESOLVES: WHEREAS, An application was filed by the City of Seal Beach, 211 8th Street, Seal Beach, California 90740; and WHEREAS, The property is described as Lots 1, 3, 5 and the southerly 12.52 feet of Lot 7 of the Bay City Subdivision A Recorder in the Office of the County Recorder of Orange County; and WHEREAS, The proposal is to renovate a recognized historic building; and WHEREAS, The subject property contains approximately 11,750 sq. ft. and is located on the west side of 8th Street approximately 30 feet north of the centerline of Central Avenue (201 8th Street); and WHEREAS, The subject property has approximately 100 feet of frontage on 8th Street and 117.5 feet on frontage on Central Avenue; and WHEREAS, The subject property contains an existing two-story public building; and WHEREAS, The surounding land use and zoning are as follows: North - 3-story public building (City Hall) PLU (Public Land Use) Zone East - Single Story Office Building C-l (Service Commercial) Zone South - 2-story public building (Orange County Fire Station) PLU (Public Land Use) Zone West - 2-story single family residence R-31 (High Density Residential) Zone; and WHEREAS, 8th Street and Central Avenue are local streets developed to their ultimate master planned width of 60 feet; and ~ WHEREAS, Section 28-2403.1 reads as follows: Section 28-2403.1. Exceptions for Noncomforming Historic Buildings. A. A locally recognized historic building or structure may be substantially preserved, renovated or rebuilt subject to the issuance of a Conditional Use Permit. B. In reviewing the application for the historic building or structure, the Planning Commission shall evaluate and make findings on the following: 1. The local historic significance of the building or structure. 2. The existing architecture. C. In approving a Historical Conditional Use Permit. the Planning Commission may authorize such deviations from the Seal Beach Municipal Code necessary to preserve the structure and its historical significance. Before approving such change, it must find: . e Resolution Number 1330 Page 2 1. All deviations from the Seal Beach Municipal Code necessary to preserve the existing structure architecturei including but not limited to: zoning, building, engineering and fire. 2. All needed agreements, contracts or conditions between the owner or lessee and any public agency which involves said building or structure are executed to insure compliance between all parties. 3. Any other appropriate conditions deemed necessary to the approval of the applications are required. 4. The waivers from Code must still render the structure safe and sound; and WHEREAS, On June 1, 1982, Heritage Orange County made an application in behalf of the City of Seal Beach to the United States Department of Interior requesting that the Seal Beach Old City Hall be placed on the National Register of Historic Placesi and WHEREAS, On August 11, 1983, the Old City Hall was entered in the National Register of Historic Places. WHEREAS, In April, 1983, California Historic Properties proposed the renovation of the Old City Hall located at 201 8th Streeti and WHEREAS, The applicant requested renovation of the public building described as follows: Lot Dimension Lot Size Height First Floor Size Second Floor Size Total Building Size Parking 1 00 ' x 117 . 5 ' 11,750 sq. ft. 36'8" (2-story) 6,629 sq.ft. 3,966 sq. ft. 10,595 sq. ft. 6 spaces on premises; and WHEREAS, The historic significance of the building is as follows: A. Old City Hall was the first and largest public building in Seal Beach. B. Old City Hall was constructed in 1929 and used as a civic center complex containing council chambers, fire station, police station and library. C. Old City Hall is historically significant for its role in the growth of Seal Beach as a permanent year-round communitYi and WHEREAS, The existing architecture is as follows: A. Old City Hall is of Mediterranean Revival style. B. Old City Hall is the only substantial Mediterranean Revival building extant in the City of Seal Beach. C. Old City Hall was joined to the new City Hall by a Mediterranean Revival extension of the new building in 1969. This attachment does not detract from the original architecture and does not disrupt the integrity of the historic architecturei and WHEREAS, The deviations from the Seal Beach Municipal Code necessary to preserve the structure's existing architecture are as follows: A. State Energy Code (Title 24) energy conservation waived under State Historic Building Code. . . Resolution No. 1330 Page 3 B. Raising of handrails below current code waived because of architectural considerations. C. Use of westerly stairway of the existing City Hall as second legal required exit from the second floor of the Old City Hall has been granted in accordance to Section 104(f) of Building Code (Historic Buildings) with the conditions that panic hardware with alarm system be installed on exit floor facing Old City Hall and sign posted over door stating "Emergency Exit." D. Existing second floor corridor will not be required to have one hour fire retardant surfaces because of the width of corridor and low traffic. E. All other code requirements, i.e., electric, earthquake, handicap will be met; and WHEREAS, At the January 9, 1984 City Council meeting, approval was given to: A. The lease agreement between the City of Seal Beach and California Historic Properties - 80; B. The sublease between CHP-80 and Group W, Inc.; C. The renovation construction plans and specifications; D. The architectural rendering; E. The financing pursuant to Section 15 of the City/CHP- 80 lease agreement; F. The abstract of lease as requested by lending institution. WHEREAS, The Planning Commission on June 6, 1984 held a public hearing on Conditional Use Permit 4-84 and Negative Declaration 3-84; and WHEREAS, The Planning Commission makes the following findings regarding the Conditional Use Permit and Negative Declaration: 1. The Old City Hall has been recognized as an historic building by its entry in the National Register of Historic Places. 2. The Old City Hall is of unique architectural design in the City of Seal Beach. 3. Agreements, contracts and conditions have been executed to insure compliance between the owner or lessee and the City of Seal Beach. 4. Waivers from present day City codes still renders the structure safe and sound. 5. The certified rehabilitation will not result in any adverse physical or aesthetic effects to this historic building as outlined in Negative Declaration 3-84; and NOW, THEREFORE, BE IT RESOLVED that the Planning Commission does hereby approve Conditional Use Permit 4-84 and Negative Declaration 3-84. . . . Resolution No. 1330 Page 4 PASSED, APPROVED AND ADOPTED BY the Planning Commission of the City of Seal Beach at a meeting thereof held on the 6th day of June , 1984 by the following vote: AYES: Commissioners Goldenberg.
