RESOLUTION #1355 A RESOLUTION OF THE SEA~ BEACH PLANNING COMMISSION APPROVING CONDITIONAL USE PERMIT CUP 19-84 FOR ON- SALE BEER AND WINE LICENSE FOR THE OLD TOWN WINE AND GOURMET AT 143 MAIN STREET. THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, an application was duly filed by Neal Ward and Richard McCollom, 143 Main Street; for CUP 19-84 for on-sale beer and wine license; and WHEREAS, the property is located at 143 Main Street; and WHEREAS, the property is described as that certain parcel of land in the City of Seal Beach, County of Orange, Lot 43, Block 8, Bay City Tract as per map recorded in Map Book 199, Page 3 in the office of the County Recorder of said County; and WHEREAS, the proposal is for a Condional Use Permit allowing on-sale beer and wine in conjunction with a public eating place (Deli) and allowing currently permitted wine tasting and off-sale beer and wine operations to continue on site as operated; and WHEREAS, past operations of the existing restaurant (Deli) have been compatible with surrounding land uses- NOW, THEREFORE BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Conditional Use Permit 19-84 subject to the following conditions: 1) CUP is approved for on-sale beer and wine in conjunction with the restaurant (Deli) at 143 Main Street and issued to the Old Town Wine and Gourmet (Neal Ward and Richard McCo 110m). 2) That all alcoholic beverages'sold in conjunction with the restaurant (Deli) operation be consumed entirely within the restaurant portion of the building. , 3) That the applicants shall comply with all restrictions placed on their license by the State Department of Alcoholic Bev.erage Control. 4) That CUP issued is non-transferable. 5) That there shall be no alcoholic beverage advertising display devises located in the window areas. 6) That approval is subject to all conditions established for Variance 15-84 and Conditional Use Permit 22-84. 7) That the term of this permit shall be for six (6) months, after which time the Planning Commission can extend the permit for another six (6) month period of time provided that all conditions of approval have been satisfied and no serious police problems have occurred. At the end of the second six (6) month period of time, the Planning Commission may extend the permit indefinitely provided that all conditions of approval have been satisfied and no significant police problems have occurred. 8) That the closing hours of operation shall be 10:pO p.m. Friday thru Saturday and 8:00 p.m.' on Sunday_ PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meeting thereof held on the 16th day of January ,1985 by the following vote: .. . .
