A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION
APPROVING CONDITIONAL USE PERMIT 2-85, A REQUEST
FOR APPROVAL OF A PERMIT FOR ON-SALE BEER, WINE AND
DISTILLED SPIRITS IN CONJUNCTION WITH THE ESTABLISH-
MENT OF A RESTAURANT LOCATED AT 201 MAIN STREET
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE:
WHEREAS, an application was duly filed by Walter R. and Mona K.
Babcock, 5611 Las Lomas, Long Beach, California; and
WHEREAS, the property is located at 201 Main Street, Seal Beach,
California and contains approximately 5,875 square feet
and is located at the northwestern corner of Central
Avenue and Main Street (201 Main Street); and
WHEREAS, the subject property is described as that certain parcel
of land in the City of Seal Beach, Orange County,
California: Lots 1 and 3, in Block 108, Bay City Tract,
as per map recorded in Book 3, Page 19, Miscellaneous
Maps, records of said Orange County; and
WHEREAS, the proposal is for a Conditional Use Permit to allow
on-sale beer, wine and distilled spirits in conjunction
with the re-establishment of a restaurant use at 201
Main Street (Walt's Wharf); and
WHEREAS, the restaurant operations conducted by Dr. Babcock have
in the past been compatible with surrounding land uses; and
NOW, TTHEREFORE BE IT RESOLVED that the Planning Commission does
hereby approve CUP 2-85 subject to the following conditions:
1. CUP is approved for on-sale beer, wine and distilled
spirits at 201 Main Street and issued to Walter R.
Babcock (Walt's Wharf).
2. That all alcoholic beverages shall be consumed entirely
within the building.
3. That the applicant shall comply with all restrictions
placed on his license by the State Department of
Alcoholic Beverage Control.
4. CUP issued is non-transferable.
5. There shall be no alcoholic beverages advertising
display devices located in the window area.
6. That this CUP shall be automatically terminated if the
operation no longer is maintained as a "bona fide"
restaurant as defined by the State Department of
Alcoholic Beverage Control.
7. That the term of this permit shall be for six (6)
months, after which time the Planning Commission can
extend the permit for another six (6) month period of
time provided that all conditions of approval have been
satisfied and no serious police problems have occurred.
At the end of the second six (6) month period of time,
the Planning Commission may extend the permit indefinitely
provided that all conditions of approval have been
satisfied and no significant police problems have occurred.
8. No sale of alcoholic beverages after 12:00 p.m.
9. Approval subject to all conditions established for Variance 3-85.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of
Sea 1 Beach at a meeting thereof held 6th day of Ma rch , 1985,
by the following vote.
AYES: Commissioners Covington, Hunt, Perrin, Ripperdan
NOES: Commissioners None
ABSENT: Commissioners Jessner
