SUBJECT: BOND RELEASE - 400 MARINA DRIVE PARCEL MAP
No. 2005-257
SUMMARY OF REQUEST:
The City Council is asked to adopt Resolution No. 5792 releasing a cash bond in
the amount of $29,254.00 for public improvements at 400 Marina Drive provided
by Mr. Alan Schwendener.
BACKGROUND:
The subject development is located at 400 Marina Drive, which is on the
southerly east corner of Marina Drive and Fourth Street.
The site is relatively level and is irregular shape, having approximately 80 feet of
frontage on Fourth Street and 137 feet of frontage on Marina Drive. The right of
way width on Fourth Street is 60 feet and on Marina Drive is 80 feet. The existing
land use is a 10 unit apartment complex. The proposed development will create
four parcels on the approximately 0.31 acres, with a minimum parcel size of
2,937.5 square feet. Each parcel is planned for a single family residence.
At the August 11, 2008 City Council Meeting, the City Council approved a parcel
map dividing one parcel into four. The four new parcels have the address of 232,
234, 236 4th Street and 400 Marina Drive. The property owner on record for said
map is Mr. Alan Schwendener who also posted a cash bond in the amount of
$29,254.00 for public improvements. Such improvements include new trees,
street lights, sidewalk and curb & gutter.
On September 8, 2008 Mr. Schwendener submitted four recorded grant deeds
transferring ownership to four new owners. Since Mr. Schwendener transferred
the ownership of said properties, the existing cash bond and agreement
submitted by Mr. Schwendener should be replaced with bonds and an agreement
from the new owners.

On September 24, 2008, the new property owners submitted a bond for the same
amount in lieu of Mr. Schwendener's bond.
At this time, the City Engineer recommends to release Mr. Schwendener's bond.
FINANCIAL IMPACT:
There is no financial impact.
RECOMMENDATION:
It is recommended City Council adopt Resolution No. 5792 releasing a cash
bond in the amount of $29,254.00 for public improvements at 400 Marina Drive
provided by Mr. Alan Schwendener.

CASH BOND FOR 400 MARINA DRIVE, PARCEL MAP No. 2005-
257
THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
SECTION 1. City Council authorizes the release of a Cash Bond in the
amount of $29,254.00 for public improvements at 400 Marina
Drive, Parcel Map No. 2005-257 to Alan Schwendener.
PASSED, APPROVED AND ADOPTED by the City Council of Seal Beach, at a
meeting hereof held on the 13th day of October , 2008 by the following vote:
