RESOLUTION NUMBER 1364
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
SEAL BEACH APPROVING A PARKING VARIANCE FOR A
RESTAURANT LOCATED AT 201 MAIN STREET (WALT1S WHARF)
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH HEREBY RESOLVES:
WHEREAS, an application for variance was duly filed by Walter R.
and Mona K. Babcock; and
WHEREAS, the property is located at 201 Main Street, Seal Beach,
California and contains approximately 5,875 square feet
and is located at the northwestern corner of Central
Avenue and Main Street (201 Main Street); and
WHEREAS, the subject property is described as that certain
parcel of land in the City of Seal Beach, Orange County,
California: Lots 1 and 3, in Block 108, Bay City Tract,
as per map recorded in Book 3, Page 19, Miscellaneous
Maps, records of said Orange County; and
WHEREAS, the subject property has approximately 50 feet of
frontage on Main Street; and
WHEREAS, the subject property contains an existing vacant building
which was formerly used for restaurant purposes (Walt1s
Wharf); and
WHEREAS, the surrounding land use and zoning is as follows:
North, south, east and west - a mixture of offices,
commercial, retail, and commercial service uses located
in the C-1 (Service Commercial) zone; and
WHEREAS, during the period between January 24, 1984 and April 24,
1984, the City Council appointed the Downtown Parking
and Urban Design Task Force, which met and formulated
recommendations to be considered by the City Council.
These recommendations have been reviewed and approved
by the Planning Commission back in June and City
Council in September. Specifically, that Task Force
recommendations on the parking questions are as follows:
a) While parking requirements must be eased in order
to encourage the infill of existing vacant lots
and improvements to existing structures, a portion
of the parking spaces must be provided on-site.
City staff should draw up recommended parking
requirements and a method of determining the on-
site/off-site ratio.
b) Some type of in-lieu fee should be established to
help mitigate future parking needs; and
WHEREAS, staff has been applying a three-point policy on parking
requirements in the Main Street area, as follows:
a) all new buildings be required additional parking
based upon its intended use, as required by City
code.
b) Occupancy of an unused portion of an existing building
for retail or residential use requires no additional
parking.
c) Replacement uses or an expansion of an existing use
to a more intense use requires additional parkings
as stipulated by the City code.
WHEREAS, the applicant specifically requests a variance to the
required number of on-site parking spaces: and
WHEREAS, the Planning Commission makes the following findings
regarding the variance:
1) Such variance will not adversely effect the General
Plan which designates the subject property for

commercial uses, including restaurants. The proposed
conditions of approval for the variance will insure
that adequate off-street parking is provided for the
proposed restaurant.
2) The Downtown Task Force has recommended and the City
Council has directed staff to implement their
recommendations to allow greater flexibility in present
parking requirements, including allowance for off-site
and in-lieu fee programs.
3) The application does not constitute a grant of special
privileges as adequate off-street parking will be
required to be provided instead of the on-site parking
spaces.
4) The proposal is specifically in conformance with the
City Council approved recommendations of the Market
and Business Analysis Task Force which states as a near
term strategy to improve tenant mix that it is desirable
to increase the amount of restaurant space within the
downtown area.
5) Due to the size, shape and 10oation of the subject
property and the location of buildings on this property,
the strict application of the code as far as to form, type,
width and location of parking, meets the legal test for a
variance under the Seal Beach Municipal Code.
NOW, THEREFORE BE IT RESOLVED that the Planning Commission does hereby
approve Variance 3-85 for: a) less than required on-site parking, b)
provision of off-street parking at a distance greater than 300 feet,
c) type, form, width and location of parking 'spaces, subject to the
following conditions:
1. That Variance 3-85 is approved for 201 Main Street
(Wa 1t I s Wharf).
2. That the applicant provide in writing an agreement
to participate in an in-lieu parking program or any
other programs the City Council may establish for
parking in the Downtown area to the amount equal to
provision of 55 spaces. If the City Council does _
not establish such a program, the applicant shall
provide a private agreement subject to approval of _
the City Attorney.
3. That a covenant be recorded on the title of the
property which stipulates that 55 additional parking
spaces are required for restaurant use of the property.
Any changes to proposed or existing on-site or
contr~ctural.parking agreements which may effect the
the conditions herein stated are subject 'to review and
update by the Planning Commission.
4,~, That ~. ~,ig!1 program be designed for all building signage
and be approved by the Director of Development Services.
5. That all requirements of the County of Orange Health
Department and Uniform Building Code be met prior to
occupancy.
6. That the applicant provide adequate trash facilities
approved by the Director of Development Services.
7. That the restaurant use not exceed the area designated
on the site plan as approved by the Planning Commission
and as modified by any other conditions.
8. That a detailed landscape and irrigation plan which
provides adequate landscaping in those areas noted in
Exhi bi t "A". Such 1 andscaped areas shall be separated
by a 6" concrete curb or similar material as approved
by the Planning Commission.
9. That a trash bin enclosure (6 ft. high block wall with
gate) be built at the rear of the property in order
to enclose the existing trash bins, and that all other
equipment/storage sheds at the rear of the property
and roof equipment be removed or adequately shielded

10. That approval is subject to all conditions established
for Conditional Use Permit 2-85.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the City
of Seal Beach at a meeting thereof held 6th day of March , 1985
by the following vote:
AYES: Commissioners Covinqton. Hunt. Perrin. Ripperdan
