After closing of the public hearing, adopt Resolution Number 5800, A Resolution of the City Council of the City of Seal Beach Revising Fees and Charges for Goods, Services and Facilities Provided by the City of Seal Beach and Superseding Inconsistent Provisions of Resolution Number 5783. BACKGROUND: On September 8, 2008 the City Council adopted Resolution Number 5783, A Resolution of the City Council of the City of Seal Beach Revising Fees and Charges for Goods, Services and Facilities provided by the City of Seal Beach and Superseding Inconsistent Provisions of Resolution Number 5569. That resolution included the appropriate fees to process the various discretionary applications in accordance with recently adopted Title 11, Zoning. Petitions have now been submitted requesting either rescission of Title 11 or the calling of an election for voter determination to approve or reject Title 11. During this period of uncertainty as to the ability of the City to implement Title 11, the City will continue to enforce the provisions of Chapter 28, Zoning. As such, staff is recommending that Section 3, Planning Fees, sub-section A, Filing Fees, be revised to reflect the previous fees utilized to process the various application requests in accordance with Chapter 28, Zoning. The. Council is requested to consider adopting amendments to the current fees and deposits set forth in Section 1 and Section 3 of City Council Resolution Agenda Item U Public Hearing -Revisions to Fees and Charges for Goods, Services, and Facilities Provided by the City of Seal Beach - Chapter 28: Zoning City Council Staff Report October 13, 2008 Number 5783 to be consistent with the land use entitlement applications pursuant to Chapter 28, Zoning . FISCAL IMPACT: Minimal. The proposed fee revisions are established to capture actual costs incurred for the provision of city goods, services, and facility use. RECOMMENDATION: Conduct public hearing. After closing of the public hearing, adopt Resolution Number 5800, A Resolution of the City Council of the City of Seal Beach Revising Fees and Charges for Goods, Services and Facilities Provided by the City of Seal Beach and Superseding Inconsistent Provisions of Resolution Number 5783. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Seal Beach hereby restates the amount of fees, rates, charges and taxes as currently set forth in Resolution Number 5783, as follows: "SECTION 1.
