Receive and File Staff Report. BACKGROUND: The Local Agency Formation Commission of Orange County ("LAFCO") has been requested certain cities and special districts within the County to provide "Any comments regarding the reconfirmation of your agency's sphere ... no later than Friday, October 18, 2008." A copy of the letter from LAFCO regarding this matter is provided as Attachment 2 for review by the City Council in considering this matter. As indicated in the LAFCO letter, this reconfirmation process, if approved by LAFCO, will eliminate the need for conducting new Municipal Service Reviews and Sphere of Influences for the agencies listed within the letter during the 2008-2012 review cycle. As part of the LAFCO reviews in 2005, and 2006, the City stated concurrence by letters on August 5, 2005, September 8, 2005, February 27, 2006 and June 26, 2006 that the City of Seal Beach sphere of influence be reaffirmed as coterminous with the City's existing jurisdictional boundaries. Should the Rossmoor incorporation effort fail and the residents there or in Sunset Beach express interest in annexing, the Council may wish to provide clarification regarding its position that the City of Seal Beach sphere of influence be reaffirmed as coterminous with the City's existing jurisdictional boundaries. A sphere of influence (SOn is a broad-brush planning boundary that helps a public agency plan for the logical extension of facilities and services as areas grow and change. The initial round of municipal service reviews (MSRs) and sphere of influence (SOn reviews for all of Orange County cities and special districts were recently completed by Orange LAFCO prior to the January 1, 2008 statutory deadline. The law now requires that LAFCO begin another round of municipal service reviews and sphere of influence updates for the next five-year cycle (2008 - 2012). Because Orange LAFCO recently completed MSRs and SOIs for the majority of agencies under LAFCO's purview, and the data used to make those determinations remain current, staff is proposing that LAFCO "reconfirm" the MSRs and SOIs for many of the cities and districts within Orange County. Comments on Draft Negative Declaration/Cate~orical Ezemntion Documents• ^ Seal Beach Suhere oflnfluence Update (SOI OS-32) -Negative Declaration The City of Seal Beach supports your proposed Negative Declaration and adoption of the SOI for Seal Beach "as coterminous with the City's existing jurisdictional boundary as shown on Exhibit B' with a change being made to Exhibit B to clearly indicate that the corporate boundary of the City extends 3 miles off-shore the Pacific Ocean, as is referenced on page 4, Previous SOI Determinations~or City of Seal Beach of your Staff Report. In addition, it is not clear in the Staff Report dated September 14, 2005 why the Joint Forces Training Center in Los Alamitos is discussed under "Present and Probable Need for Public Facilities and Services", and also in the proposed "Statement of Determinations" under "Present and Probable Need for Public Facilities and Services", as any future land use changes at the Joint Forces Training Center will be determined by the City of Los Alamitos, and there would not be any services provided to this property by the City of Seal Beach. The current documents provided to the City did not include the •SOI maps, so it uncertain if the requested map boundary corrections have been made. .Please ensure that the district map boundaries are correct in the final documents to be approved by LAFCO. In addition, Figure 3b on page 5 of the "Surfside Colony Community Services Tax District & Surfside Colony Storm Water Protection Tax District -Municipal Service Review and Sphere of Influence Review" document includes a photograph of a structure that is not within Surfside Colony. The pictured structure is a residence, but is located outside of Surfside Colony. It is suggested that another picture of residences within Surfside Colony be inserted. With the above corrections and modifications, the City of Seal Beach supports your proposed Categorical Exemptions and adoption of the SOI for Surfside Colony Community Services Tax District and Surfside Colony Storm Water Protection Tax District. ^ Rossmoor Community Services District Sphere oflnfluence Update (SOI OS-33) -Negative Declaration: . The City of Seal Beach supports your .proposed Negative Declaration and adoption of the SOI for Rossmoor Community Services District.. The City notes that Rossmoor Community Services District has requested LAFCO to consider "the expansion of Rossmoor's SOI to include the immediately adjacent area known as Rossmoor Center", and that LAFCO has not considered that request. Seal Beach would not agree to any such transfer of Rossmoor Center under any circumstances that we can identify at this time, and would categorically reject any such effort. Any effort to reduce the revenues of the City of Seal Beach will be vigorously fought by the City, including the initiation of litigation if the idea of transferring Rossmoor Center is contemplated. The City of Seal Beach supports your proposed Negative Declaration and adoption of the SOI for Rossmoor/Los Alamitos Area Sewer District. It is the opinion of the City of Seal Beach that the Rossmoor governance documents referenced above are uncleaz and too speculative for the City to rely heavily on and feels that many of the assumptions and parameters regazding•the projection of revenues and expenditures that would be generated by any of the above-mentioned alternative governance scenarios is insufficient to make any type of an informed decision. Therefore, Seal Beach again wishes to support its concurrence with LAFCO staff "that the City of Seal Beacl: sphere of influence be reaffrmed as conterminous with the City's existing jurisdictional boundary."
