RESOLUTION NUMBER 1366 A RESOLUTION OF THE CITY OF SEAL BEACH PLANNING COMMISSION APPROVING A REQUEST TO ALLOW A SET OF NON-HABITABLE ARCHITECTURAL FEATURES TO DEVIATE FROM THE BUILDING HEIGHT LIMITS IN CONJUNCTION WITH A NEW RESIDENCE (119 TWELFTH STREET) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, an application was duly filed by Douglass M. Sheppard, 119 Twelfth Street, Seal Beach, California 90740; and WHEREAS, the property is described as Lot 19, Block 11 of Tract AOl15 (Bay City Tract) of the Recorder, Orange County, California; and WHEREAS, the subject property contains approximately 4,406 square feet located on the western side of 12th Street between Ocean Avenue and Central Avenue (119 Twelfth Street); and WHEREAS, the subject property has approximately 37.5 feet of frontage on 12th Street; and WHEREAS, the subject property contains a one-story residential building; and WHEREAS, the surrounding land use and zoning are as follows: North, South, East and West - a mixture of single- family and multi-family residences in the R-3 (High Density Residential) zone; and WHEREAS, on March 13, 1985, the applicant applied for a Minor Height Deviation Permit 1-85; and WHEREAS, the applicant specifically requested the following Minor Height Deviation as described as follows: "Roof for octagonal turret required to have 2:1 minimum slope to compliment Victorian styling of residence. A portion of this roughly conical shape must exceed the 25' building height limit"; and WHEREAS, the proposal is exempt for environmental review; and WHEREAS, on April 17, 1985, the Planning Commission held a public hearing on Minor Height Deviation 1-85; and WHEREAS, the Planning Commission makes the fallowing findings regarding the Minor Height Variation: 1. That the height deviation is for a non-habitable architectural feature. 2. That the height deviation is appropriate for the character and integrity of the neighborhood. 3. That the building height deviation is appropriate for the architectural style of the building. 4. That the height deviation does not significantly impair the primary view from any property located within 300 feet. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Minor Height Deviation Permit 1-85. PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meeting thereof held on the 17th day of April , 1985 by the following vote: . , .
