RESOLUTION NUMBER 1372
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF SEAL BEACH APPROVING CONDITIONAL USE PERMIT 4-85.
A REQUEST TO PERMIT ~ WALK UP/TAKE-OUT RESTAURANT
(DELI) IN A PORTION OF AN EXISTING LUCKY'S STORE
(12121 SEAL BEACH BOULEVARD).
The Planning Commission of the City of Seal Beach, California,
hereby resolves:
WHEREAS, an application was duly filed by Lucky Stores, Inc.;
and
WHEREAS, the subject property is the Rossmoor Business Center
located on the westside of Seal Beach Blvd., north
of St. Cloud Drive ( 12121 Seal Beach Blvd.); and
WHEREAS, the subject property has approximately 4,000 feet
of frontage on Seal Beach Blvd., and a depth varying
from 142 feet to 1,200 feet; and
WHEREAS, the property contains several retai1-commercai1 build-
ings of which the Lucky's building is a separate parcel
sharing the benefit of a common parking lot; and
WHEREAS, the surrounding land uses and zoning are as follows:
North, West and South - single family residences
located in the community of Rossmoor in the
unincorporated territory of the County of Orange.
East - a mixture of open space utilized for the
most part as a golf course in the R-G Zone, retai1-
commercial uses in the C-1 Zone and residential
uses in the City of Los Alamitos; and
WHEREAS, the restaurant (Deli) was operated by the previous
owner (Smith's Food King) without the required
Conditional Use Permit; and
WHEREAS, the applicant specifically requested CUP 4-85 to
legally permit the continuing operation of a walk-up/
take-out restaurant (Deli) in a General Commercial
(C-2) Zone (Rossmoor Center); and
WHEREAS, the applicant is not increasing the present size of
the building nor proposing any structural alterations
which would necessitate the property's conformance to
Municipal Code requirements pertaining to landscaping
and signage; and
WHEREAS, on May 15, 1985, the Planning Commission held a public
hearing on Conditional Use Permit 4-85.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission does hereby
approve Conditional Use Permit 4-85 with the following conditions:
1) Conditional Use Permit is approved for a wa1k-up/
take-out restaurant (Deli) at 12121 Seal Beach Blvd.
and issued to Lucky, Inc.
2) That the Conditional Use Permit is non-transferable.
3) That the development be in accordance with the floor
plans as approved by the Planning Commission and as
modified by the above conditions.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of
Seal Beach at a meeting thereof held on the 15th ,day of
May , 1985, by the following vote:
