RESOLUTION-NUMBER 1375 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING VARIANCE 6-85, A REQUEST TO ALLOW DEVIATIONS FROM THE REQUIRED SIDE YARD SETBACK AND TO PERMIT THE USE OF TANDEM PARKING (1619 SEAL WAY). THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH HEREBY RESOLVES: WHEREAS, an application was duly filed by Gary and Grace Canady; (1619 Seal Way); and WHEREAS. the property is described as that certain parcel of land in the City of Seal Beach, County of Orange, State of California, described as Lot 27 of Block 94 as per map recorded in Map Book 199, Page 9 inclusive in the office of the County Recorder of said County; and WHEREAS, the subject property contains approximately 1,875 sq. ft. and is located 253 z ft. southwest of the center- line of Electric Avenue (1619 Seal Way); and WHEREAS, the property has apprOXimately 30 feet"of-frontage on Seal Way and a depth of approximately 101 feet. The property abuts the rear alleyway for approximately 7.5 feet; and WHEREAS, the property contains a 1,150 z sq. ft. legal non- conforming duplex. The property currently provides no covered parking spaces on the site; and WHEREAS, the surrounding land uses and zoning are as follows: North, East West - a mixture of single family and multi-family residences located in the R-3 (High Density Residential) zone. South - the Seal Way boardwalk, beach and Pacific Ocean in the PLU (Public Land Use) zone; and WHEREAS, the existing building is nonconforming due to density and parking. The applicant indicated a desire to convert the existing duplex into a single family residence; and WHEREAS, the applicant requested approval to perform structural alterations and additions to a legal nonconforming property which would intrude upon the required side yard setbacks. Specifically, the applicant requested Variance 6-85 in order to permit the construction of two covered garages, set in tandem. One of the proposed garages would be placed on a portion of the westerly property line. The proposal is made in conjunction with the conversion of an existing duplex to a single family residence which will eliminate the density nonconformity; and WHEREAS, on May 15, 1985, the Planning Commission held a public hearing on Variance 5-85; and WHEREAS, the Planning Commission makes the follOWing findings regarding Variance 5-85: 1) All showings required by Section 28-2502 have been satisfied for the property. 2) The proposed additions would serve to make the property more conforming in terms of density and number of covered parking spaces. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission does hereby approve Variance 5-85 with the following condition. 1) That the second floor deck intrusion on the eastern side yard of the prop-erty not be permitted 2) No active use of the property be located on the second level within the 3 ft. minimum side yards and such use be physically separated. ~ i . .
