A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION
APPROVING CONDITIONAL USE PERMIT 6-85, A REQUEST TO
PERMIT ON-SALE BEER AND WINE IN CONJUNCTION WITH AN
EXISTING RESTAURANT WALK-IN/TAKE-OUT DELI LOCATED AT
223 MAIN STREET (NICK'S DELI).
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE:

an application was duly filed by Dominic Zampino
for Nick's Deli (223 Main Street)i and
the property is a rectangular shaped parcel of
land containing approximately 5875 sq. ft. and
is located 130+ ft. southwest of centerline of
Central Avenue-(223 Main St.)i and.
the property is described as lot 23 in Block 108
of the Bay City Tract, in the City of Seal Beach,
County of Orange, State of California, as shown
on a map recorded in Book 3, Page 19 of Miscellaneous
Maps in the office of the County Recorder of said
CountYi and
the property has approximately 87.5 ft. of frontage
on Main Streeti and
the applicant is specifically requesting CUP 6-85 to permit
an on-sale beer_and wine license in order to compliment the
menu of an existing restaurant/take-out delii and
Stacey Picascia, Chief of Police, has researched
existing records and has no reservations regarding
the approval of this CUP by the Planning Commissioni
and
on June 19, 1985, the Planning Commission held
a public hearing on CUP 6-85.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
does hereby approve CUP 6-85 subject to the following conditions:
1. CUP is approved for on-sale beer and wine at 223 Main Street
in conjunction with the take-out restaurant (Deli) operation
and issued to "Nick's Deli" (Dominic Zampino).
2. That all alcoholic beverages sold in conjunction with the
restaurant (deli) operation be consumed entirely within
the restaurant portion of the bUilding.
3. That the applicant shall comply with all restrictions placed
on their license by the State Department of Alcoholic Beverage
Control.
4. That the CUP is non-transferable.
5. That there shall be no alcoholic beverage advertising display
devices located in the window area.
6. That approval is subject to all conditions established
for Variance 9-85.
7. CUP to be reviewed by staff at the end of one year.

City of Seal Beach at a meeting thereof held on the 19th
