HomeMy WebLinkAboutPC Res 1384 - 1985-06-19 # , 411 RESOLUTION NUMBER 1384 411, A RESOLUTION OF THE CITY OF SEAL BEACH PLANNING COMMISSION APPROVING VARIANCE 8-85, A REQUEST TO PERMIT A GARAGE ADDITION TO A NON-CONFORMING PROPERTY WITHOUT PROVIDING THE REQUIRED PARKING AND TO PERMIT THE GARAGE ADDITION TO INTRUDE INTO THE REQUIRED SIDE YARD SETBACK. (1510 MARINE AVENUE) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, an application was duly filed by Dan Sullivan, 1510 Marine Drive, #2, Seal Beach, CAt and the property contains approximately 5825 sq. ft. and is located approximately 95 ft. from the centerline of Dolphin Avenue (1510 Marine Avenue); and the property is described as that certain parcel of land in the City of Seal Beach, Orange County, California: Lot 4, in Block G, in Tract 84, as recorded by the County Recorder of said Orange County; and the property has approximately 50 ft. of frontage on Marine Avenue; and the property contains an existing two-story apartment building (7 units) which is non-conforming due to parking, density and setbacks; and the proposal is to allow for the provision for as many cars as is physically feasible without the alteration of the existing structure; and the property's existing structures includes 7 units and would, therefore, require 14 covered spaces to be provided to comply fully with Section 28- 802. The applicant is proposing to provide 5 covered spaces; and review of submitted plans has indicated that the proposed covered parking spaces would be contructed inside the required sideyard setback; and due to the size limitations associated with the property, staff proposes the use of two tandem parking spaces which would be covered with a carport instead of a garage so to allow adequate pedestrian circulation to the structure and maximize the allowable covered parking for the site at 7 spaces; and such Variance will not adversely affect the General Plan; and because of special circumstances applicable to the property's size and shape, the strict application of this Chapter deprives the property of privileges enjoyed by other properties in the same vicinity and zone; and the granting of the Variance does not constitute a grant of special privilege inconsistent with other limitations upon other properties in the same vicinity and zone; and that in providing the maximum number of possible spaces at the site, some intrusion into the required side yard setback would be required based on the size and shape of the lot; and . . ~ RESOLUTION #1384 PAGE 2 WHEREAS, that in providing the maximum number of possible spaces at the site, tandem parking is necessary and beneficial to the property and surrounding neighborhood; and WHEREAS, on June 19, 1985, the Planning Commission held a public hearing on Variance 8-85. NOW, THEREFORE BE IT RESOLVED that the Planning Commission does hereby approve Variance 8-85 subect to the following conditions: 1. That the proposed plan (Attachment A), as submitted by staff, be implemented by the applicant in order to maximize the number of covered parking spaces possible on the site. 2. That Variance 8-85 is approved as amended by staff permitting an intrustion into the required side yard setback. 3. That the use of tandem spaces and a carport, as recommended by staff be approved in conjunction with the recommended plan submitted by staff. 4. That all sections of the UBC be complied with. 5. That all conditions associated with CUP 12-85 are adhered to. PASSED, APPROVED AND ADOPTED by the Planning Commission of the Cit~ of Seal Beach at a meeting thereof held on the 19th day of June , 1985, by the following vote: AYES: NOES: ABSENT: Commissioners: Hunt, Jessner, Perrin Commissioners: None Commissioners: Ripperdan
