RESOLUTIDN NUMBER 1389 A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION APPROVING VARIANCE 10-85 A REQUEST TO PERMIT A STRUCTURAL ADDITION TO A LEGAL NON-CONFORMING BUILDING WITHOUT PROVIDING THE REQUIRED PARKING AND LANDSCAPING (323 MAIN STREET) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, an application was duly filed by James Hagel, 323 Main Street, Seal Beach, California; and WHEREAS, the property is described as Lots 23 and 25 in Block 208 of Stanton and Lothian's First Addition to Bay City, in the City of Seal Beach, as per Map recorded in Book 3, Page 29, Miscellaneous Maps, in the office of the County Recorder of Orange County; and WHEREAS, the proposal is to allow an addition to a commercial building without providing the required parking and landscaping; and WHEREAS, on September 17, 1984, the City Council directed the staff to implement the recommendations of the Downtown Revitaliza- tion Task Force, specifically the Task Force Recommendations that pertain to this request are as follows: *From a streetscape and parking perspective, all three blocks should promote visual continuity. *The on-street parking along the 300 block of Main Street should be studied toward using more diagonal parking. (This recommendation has been studied and determined to be feasible and will be implemented soon so as to visually correct all three blocks of Main Street). *Some type of in-lieu fee should be established to help mitigate future parking needs. *While parking requirements must be eased in order to encourage improvements to existing structures, a portion of the parking spaces must be provided on-site to the extent physically possible; and WHEREAS, the variance will not adversely effect the General Plan because the use is consistent with the General Plan; and WHEREAS, the Downtown Task Force has recommended and the City Council has directed staff to implement their recommenda- tion to allow greater flexibility in present parking requirements, including allowance for off-site provisions and in-lieu programs subject to a good faith effort by the landowner; and WHEREAS, the application falls within the intent of Galifornia Government Code Section 65906.5 on parking variances if in-lieu or other facilities are provided instead of the on-site parking spaces; and WHHRAS, the proposal as modified is specifically in conformance with the City Council approved Task Force recommendations to: *Upgrade the streetscape of Main Street with particular attention placed on the 300 block. *10 promote visual continuity from a streetscape and parking perspective from the 100 and 200 blocks to the 300 block. *Incorporating existing land area into the optimal parking layout. . . RESOLUTION NUMBER 1389 Page 2 WHEREAS, the granting of this Variance as conditioned does not constitute a grant of special privilege inconsistent with other limitations upon other properties in the same vicinity and zone. WHEREAS, on August 21, 1985, a public hearing was held for Variance 9-85. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Seal Beach does hereby approve Variance 9-85 subject to the following conditions: 1) That the applicant obtain a written authorized..parking agreement from the City Council of Seal Beach for three spaces. Such annual parking agreement with the City shall be in effect until such time as an "in-lieu" program is in effect. The City retains the right then to have the applicant comply with any permanent "in-lieu" program developed. 2) That a covenant be recorded on the title of the property which stipulates that 13 parking spaces are required for professional office use of the property. 3) That the trash enclosure in the rear of the property be completed with stucco or plaster and a wooden gate added. 4) That the development be in accordance with the site plan presented to staff and subsequently approved by the Planning Commission. 5) That a detailed landscape and irrigation plan which incorporates the landscape areas be consistent with the comments and the public hearing received by the Planning Commission and be approved by the Director of Development Services. 6) That a low level. wall or screen planting be provided along the property line adjacent to Main Stree~, as approved by the Director of Development Services. 7) That the northern existing driveway be required and the sidewalk area fronting the property be removed and replaced with a decorative sidewalk treatment per the approval of the City Engineer.. 8) That one street tree be provided as approved by the City Engineer.
