RESOLUTION NUMBER 1395 . ~~ i A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION APPROVING CONDITIONAL USE PERMIT 17-85 FOR THE ESTABLISHMENT OF A WALK- IN/TAKE-OUT YOGURT SANDWICH RESTAURANT AT 216t MAIN STREET (SERGE) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, an application was duly filed by Cheryl Serge, 6334 Elm~uist Ave., Whittier, California; and WHEREAS, the property is located at 216t Main Street, Sea) Beach, California; and WHEREAS, the property is described as Lots 14 and 16, Block 109, Bay City, City of Seal Beach, as per map recorded in Book 3, Page 19 of Miscellaneous Maps in the office of the County Recorder of said County; and WHEREAS, the property's use is being intensified from a professional office (Flying Fingers Typing) to a take-out restaurant use which necessitates the provision of additional parking spaces on-site; and WHEREAS, the property is located in a C-l (Service Commercial) Zone; and WHEREAS, the surrounding land uses and zoning are as follows: North, West and South - A mixture of commercial-retail located in the C-l (Service Commercial) Zone East - A mixture of residential uses located in the R-3 (High Density Residential) Zone; and WHEREAS, the market and tenant mix study prepared for the City as part of the Downtown Revitalization Study by Keyser Marston Associates, Inc., land use and real estate economic consultants, noted that an increase in the amount of restaurant space by 10,000 to 20,000 sq. ft. from the existing 40,000 sq. ft. would be the ideal market tenant distribution for the speCialty retail nature of the downtown area; and WHEREAS, the Market and Business Analysis Task Force on Downtown Revitalization recommended the following speCifically addressing the tenant mix: a. It shall be explicitly clear that the following be only in the form of a recommendation as near term strategy to improve the store mix in the existing space and that the City in no way be able to legislate or mandate the choice of tenancy. It is desirable to: 1) decrease the amount of personal service and convenience goods space. 2) increase the amount of restaurant space, and 3) retain the present amount of comparison goods space; and WHEREAS, the proposal is for a Conditional Use Permit to allow a walk-in/take-out yogurt-sandwich establishment; and WHEREAS, on September 18, 1985, the Planning Commission held a public hearing on Conditional Use Permit 17-85. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission does hereby approve Conditional Use Permit 17-85 subject to the following conditions: ' . - . RESOLUTION NO. 1395 PAGE 2 e- 1. That the Planning Commission finds the proposed walk-in/take- out frozen yogurt/sandwich establishment to be of a similar use to restaurants allowed in the C-1 (Service Commercial) Zone. 2. That CUP 17-85 is approved as submitted and issued to Cheryl Serge for 216~ Main Street. 3. CUP issued is non-transferable. 4. Approval is subject to all conditions established for Variance 13-85. PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meeting thereof held on the 2nd day of October 1985 by the following vote: AYES: Commissioners: Covington, Hunt, Jessner, Perrin, Ripperdan NOES: Commissioners: None ABSENT: Commissioners: None the Planning Commission Commission
