HomeMy WebLinkAboutPC Res 1402 - 1985-12-18 ;'. . . . / RESOLUTION NUMBER 1402 A RESOLUTION OF THE CITY OF SEAL BEACH, PLANNING COMMISSION APPROVING CONDITIONAL USE PERMIT 20-85, A REQUEST FOR AN ON-SALE BEER AND WINE LICENSE TO BE USED IN CON- JUNCTION WITH A PROPOSED DINNERHOUSE RESTAURANT (RESTAURANT ST. JOHN) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH HEREBY RESOLVES: WHEREAS, on November 19, 1985, an application for Conditional Use Per~it 20-85 was submitted to the Department of Development Services; and WHEREAS, the subject property is described as Lots 18 and 20 of Block 209 of the Bayview Tract, Seal Beach, California, as recorded in Book 9, Page 91 of the Orange County Recorder1s office; and WHEREAS, the subject property is a rectangular shaped parcel of land containing approximately 5198 sq. ft. and is located 165 . feet north of the centerline of Electric Avenue (320 Main Street); and WHEREAS, the subject property has approximately 28.5 ft. of frontage on Main Street; and WHEREAS, the subject property contains a newly constructed (5320 sq. ft.) commercial building with five on-site parking spaces; and WHEREAS, a parking variance for the restaurant was approved on November 7, 1984 (Variance 11-85) and amended December 4, 1985; and WHEREAS, the restaurant use is specifically in accord with the Downtown Revitalization Task Force recommendation IIthat it would be desirable to increase the amount of restaurant space on Main Street. II It is also in conformance with the recommendation of Keyser Marston & Associates, Inc. - Real Estate Economics Consultants - which stated that lIa series of small ethnic restaurants would appear to have a good chance of success and would attract more people to the whole Downtown Areall; and WHEREAS, the applicant is specifically requesting CUP 20-85 to permit an on-sale beer and wine license in order to compliment the menu of a Louisiana-style Cajun dinnerhouse (Restaurant St. JOhn); and WHEREAS, Stacy Picascia, Chief of Police, has researched existing records and has no reservations regarding the approval of this CUP by the Planning Commission; and WHEREAS, on December 18, 1985, the Planning Commission held a public hearing on CUP 20-85. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission does hereby approve Conditional Use Permit 20-85 subject to the following conditions: 1. That CUP 20-85 is approved as submitted for on-sale beer and wine at 320 Main Street in conjunction with the dinnerhouse restaurant operation and issued to John and Carolyn Fagot (Restaurant St. JOhn). 2. That all alcoholic beverages sold in conjunction with the restaurant operation be consumed entirely within the restaurant portion of the building. 3. That the restaurants hours of operation be limited to 10:30 a.m. to 11:00 p.m., Monday through Sunday. ~ . . I .. .- . . Resolution Number 1402 4. That all alcoholic beverages sold be served by a waitress. 5. That the applicant shall comply with all restrictions placed on their license by the State Department of Alcoholic Beverage Control. 6. That the CUP issued is non-transferable. 7. That there shall be no alcoholic beverage advertising display devices located in the window area. 8. That approval is subject to all conditions established for Variance 11-84 (Kyle). 9. CUP to be reviewed by staff at the end of six months. PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meeting thereof held on the 18th day of December , 1985 by the following vote: AYES: Commissioners Hunt, Jessner. Perrin. Riooerdan NOES: Commissioners Covington ABSENT: Commissioners None
