RESOLUTION #1406
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
SEAL BEACH DENYING CONDITIONAL USE PERMIT 1-86. WITHOUT
PREJUDICE.A REQUEST TO APPROVE A PLANNED SIGN PROGRAM FOR
THE SEAL BEACH CENTER (921 Pacific Coast Highway).
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
WHEREAS. on November 27. 1985. an application was duly filed by
Coast Property Management for the Seal Beach Center
(921 Pacific Coast Highway, Seal Beach. California);
and
WHEREAS. the subject property is described as Lot 161. Tract
2591. and is more commonly known as the Seal Beach
Center; and
WHEREAS. the subject property contains 7.49 acres and is located
between Bolsa Avenue and Balboa Drive on the north side
of Pacific Coast Highway (commonly known as the Seal
Beach Center): and
WHEREAS. in 1978, the City of Seal Beach conducted many hearings
and discussions on modification of its sign ordinance
at that time. The result was the adoption of a revised
sign ordinance with an amortization period: and
WHEREAS. the non-conforming sign amortization period for non-
conforming signs expired on January 11. 1984; and
WHEREAS. the Urban Design and Parking Downtown Task Force
unanimously stated that signage on Pacific Coast
Highway and in Old Town strictly comply to the 15 ft.
maximum height provision and that present non-
conforming illegal signs be promptly removed: and
WHEREAS. on December 19, 1983. the Principal Planner informed
the center owner of the sign amortization period and
specifically noted the future illegal nature of the
signs for Safeway. Skaags. Tiny Naylor's and the center
sign in particular; and
WHEREAS. on February 6. 1985. the Planning Commission directed
staff to actively pursue legal enforcement of Section
28-1811 (sign amortization period). Staff then sent
letters to Tastee Freeze. Safeway. Tiny Naylor's, Coast
Property Management. and the Car Wash directing compli-
ance with Section 28-1811; and
WHEREAS. as a result of these notices. the applicant is
specifically requesting the approval of a planned sign
program which includes plan~ for a 22 foot high center
identification sign: and
WHEREAS, the Planning Commission held a public hearing on
Conditional Use Permit 1-86 on January 2, 1986.
NOW. THEREFORE. BE IT RESOLVED that the Planning
hereby deny Conditional Use Permit 1-86 for
reasons:

3. Existing signs included in the proposed Planned Sign Program
do not meet the minimum design standards adopted for that
purpose.
4. An amortization period has not been proposed by the
applicant which would ensure the timely compliance of these
signs to the minimum design standards.
5. Approval constitutes a grant of special privilege and allows
substantially greater visibility than the standard provision
allows.
6. The proposed sign program violates the intent of Section 28-
1804(4).
7. The proposed sign program is not compatible with surrounding
uses and is detrimental to the neighborhood.
8. The applicant has submitted this application for a Planned
Sign Program three (3) times. The Planning Commission
denied or continued these applications and directed the
applicant to submit a Planned Sign Program for the entire
center including all the corrections described above. The
applicant has again submitted the same application without
making the required corrections.
9. The Urban Design and Parking Downtown Task Force unanimously
requested that signage on P.C.H. strictly comply to the 15
ft. maximum height provision.
PASSED. APPROVED AND ADOPTED by the Planning Commission of the
City of Seal Beach at a meeting thereof held on the _Ujl~~_ day
