RESOLUTION NUMBER 1408 A RESOLUTION OF, THE CITY OF SEAL BEACH PLANNING COMMISSION APPROVING AND RECOMMENDING APPROVAL TO THE CITY COUNCIL OF ZONE CHANGE 1-86, A REQUEST TO CHANGE THE ZONING DESIGNATION OF 225 ACRES OF THE HELLMAN AND ORANGE COUNTY FLOOD CONTROL PROPERTIES FROM C-2 (GENERAL COMMERCIAL), R-1 (LOW DENSITY RESIDENTIAL), O-E (OIL EXTRACTION) AND PLU (PUBLIC LAND USE) ZONES TO S.P.R. (SPECIFIC PLAN REGULATION ZONE) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH HEREBY RESOLVES: WHEREAS, The subject property is a 225 acre parcel of land located northeast of Pacific Coast Highway, north of Marina Hill and west of Seal Beach Boulevard; and WHEREAS, The subject property is described as noted in Exhibit "A" (attached); and WHEREAS, The property is presently undeveloped and is used for oil extraction, with a small portion adjacent to Marina Hill used for a passive community park; and WHEREAS, On December 5, 1979, upon the motion made by Planning Commissioner Ripperdan, the Commission unanimously moved to recommend to the City Council that the City prepare a Specific Plan for all Hellman land; and WHEREAS, On January 14, 1980, the City Council approved the recommendation of the Planning Commission that the Specific Plan concept be used for the area proposed for development of the Hellman properties; and WHEREAS, On August 20, 1980, the City Council and Planning Commission held a joint study session on the potential development of the Hellman property; and WHEREAS, On April 21, 1981, the Environmental Quality Control Board recommended to the City Council that the Final Draft Environmental Impact Report on the proposed Hellman Specific Plan was adequate and in compliance with the Seal Beach Environmental Guidelines; and WHEREAS, On May 20, 1981, the Planning Commission held a public hearing on the Hellman Specific Plan and required amendments to the Land Use, Open Space/Recreation/Conservation, and Circulation Elements of the General Plan. After the public hearing, the Planning Commission approved Resolutions Number 1227 and 1228 approving the Hellman Specific Plan and the General Plan Amendment, proposed and recommended adoption by the City Council; and WHEREAS, On June 8, 1981, the City Council, after a public hearing moved to approve the following Ordinance and Resolutions relating to the adoption of the Hellman Specific Plan: A. Resolution Number 3066 - making certain environmental findings B. Resolution Number 3067 - amending the Land Use Element of the General Plan C. Resolution Number 3068 - amending the Open Space/ Recreation/Conservation Element of the General Plan D. Resolution Number 3069 - amending the Circulation Element of the General Plan E. Ordinance Number 1097 - adopting the Hellman Specific Plan; and WHEREAS, on July 22, 1981, the Hellman Specific Plan Ordinance became effective; and WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, . . On August 1~. 198,1, Ponderosa Homes submitted an application for consideration of proposed Tentative Tract Map Number 11302 and Precise Plans for the Hellman Specific Plan area; and On November 4, 1981 and November 18, 1981, the Planning Commission held public hearings on Tentative Tract Map Number 11302 and Precise Plans for the Hellman Specific Plan Area. After the pUblic hearing, the Planning Commission adopted Resolutions Number 1245 and 1246.and recommended that the City Council approve the Precise Plan and Tentative Tract Map; and On December 14, 1981, the City Council held a public hearing on the proposed Precise Plans and Tract Map. The City Council then adopted Resolutions Number 3118 and 3119 approving the Precise Plans and Tentative Tract Map proposed for the Hellman Property Specific Plan Area; and On February 3, 1982, the Planning Commission unanimously recommended approval of Tentative Parcel Map 82-1001 to the City Council by adoption of Resolution Number 1251. Tentative Parcel Map Number 82-1001 proposed the subdivision of the Hellman Property into four (4) parcels so to provide a mechanism to delineate the park sites and dedicate the extension of First Street to the City; and On February 22, 1982, the City Council adopted Resolution Number 3131 approving Tentative Parcel Map Number 82-1001; and On February 14, 1983, the City Council moved to grant a time extension of twelve months for Tentative Pancel Map 82-1001; and On November 14, 1983, the City Council granted a time extension of twelve months for Tentative T~act Map Number 11302; and On November 26, 1984, the City Council granted a time extension of twelve months until December 14, 1985, for Tentative Tract Map 11302; and On April 3, 1985, the Planning Commission reviewed the proposed revisions, amendments and additions to the City of Seal Beach State Lands Specific Plan prepared by staff pursuant to City Council direction on November 19, 1984; and On May 1, 1985, the Planning Commission held a public hearing on Zoning Text Amendment 4-85 which proposed the establishment of specific standards, criteria, regulations and procedures on the adoption of Specific Plans. In addition, also proposed the establishment of a Specific Plan Regulation Zone (SPR Zone); and On June 24, 1985, the City Council held a public hearing on ZTA 4-85. After discussion, the City Council moved to refer the item back to the Planning Commission with the changes proposed by the City Council; and On August 7 and August 14, 1985, the Planning Commission considered those changes proposed by the City Council on ZTA 4-85 and made recommendations upon those changes proposed; and On September 23, 1985, the City Council upon receipt of the Planning Commission's recommendations, adopted Ordinance Number 1193, IIAN ORDINANCE OF THE CITY OF SEAL BEACH ESTABLISHING A SPECIFIC PLAN REGULATION ZONE AND SPECIFIC PLAN PROCEDURESII: and The current request is the amendment of the Zoning Map of the City of Seal Beach for the property from C-2 (General Commercial), R-1 (Low Density Residential), O-E (Oil Extension), and PLU (Public Land Use) Zones to the newly effect Specific Plan Regulation (S.P.R.) Zone; and . . . . WHEREAS, The proposed zone change would not adversely affect the General Plan; and WHEREAS, The proposed zone change would have no significant impact upon the environment, as outlined in the Negative Declaration 1-86; and WHEREAS, On January 2, 1986 and February 5, 1986, the Planning Commission held a public hearing on Zone Change 1-86. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission does hereby approve and recommend approval by the City Council of the requested amend- ment of the Zoning Map of the City of Seal Beach for the property noted as Exhibit "A: (attached) from the C-2 (General Commercial), R-1 (Low Density Residential), O-E (Oil Extraction), and PLU (Public Land Use) Zones to the S.P.R.' (Specific Plan Regulation) Zone. PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meeting thereof held on the 5th day of February , 1986, by the following vote: AYES: Commission Members Covington, Hunt, Jessner, Perrin, Ripperdan NOES: Commission Members None ABSENT: Commission Members None ATTEST:
