RESOLUTION NUMBER 1426
A RESOLUTION OF THE PLANNING COMMISSIO~ OF THE CITY OF
SEAL BEACH APPROVING VARIANCE 12-85, A REQUEST TO ALLOW
A MAJOR STRUCTURAL ALTERATION AND REMODEL TO A GROCERY
STORE O~ A COMMERCIAL SITE WITH LESS THAN THE REQUIRED
LANDSCAPIXG (12121 Seal Beach Boulevard)
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
WHEREAS, an application was duly filed by Lucky Stores, Inc.,
(6565 Knott Avenue, Buena Park, California); and
WHEREAS, a duly noticed public hearing was held on November 20,
1985:, and
WHEREAS. the property on which the applicant is located is the
Rossmoor Business Center located on the west side of
Seal Beach Blvd., north of St. Cloud Drive (12121 Seal
Beach Blvd.): and
WHEREAS,
the subject property
frontage on Seal Beach
from 142 feet to 1200
square feet; and
has approximately 4000 feet of
Boulevard, and a depth varying
feet, for a total of 1.721.075
WHEREAS. the property is located in the C-2 (General Commercial)
Zone, and contains several retail-commercial bUildings;
and
WHEREAS. the surrounding land uses and zoning are as follows:
North and South Single family residences located in
the community of Rossmoor in the unincorporated
territory of the County of Orange.
West MUltiple family residences located in the
Residential High Density Zone, and single-family
residences located in Rossmoor.
East - A mixture

WHEREAS. the Rossmoor Center is non-conforming due to
substandard landscaping with 172.108 sq. ft. required

WHEREAS. that portion of the landscaping required of each tenant
that cannot be located in the immediate lease area may
be placed elsewhere in the Rossmoor Center: and
WHEREAS. Lucky Stores. Inc. has submitted plans providing 11,310
sq. ft. of landscaping to be distributed to the south
and east of the store. thus meeting the conditions
outlined above: and
WHEREAS. the special circumstances of the multi-tenant shopping
center use of the subject property would deprive the
applicant of privileges enjoyed by other property in
the same vicinity and zone if the subject property was
subject to the strict application of the Municipal
Code: and
WHEREAS, the granting of the proposed variance would not
constitute a granting of special privilege inconsistent
with other limitations upon other properties in the
same vicinity and zone, since the applicant proposes to
provide his full share of landscaping; and
WHEREAS, the granting of the variance would not adversely affect
the General Plan.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission does
hereby approve Variance 12-85.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the
City of Seal Beach. at a meeting held on the ___~20t~______ day
