HomeMy WebLinkAboutPC Res 1428 - 1986-08-13 .: . , RESOLUTION NUMBER /~SI A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING VARIANCE 9-86 AND CONDITIONAL USE PERMIT 17-86. TO ALLOW THE USE OF A 34 FOOT LONG, TANDEM STYLE GARAGE WHICH WOULD RESULT IN A TWO-STORY ENCROACH- MENT INTO THE FIVE-FOOT REAR YARD SETBACK, IN CONJUNCTION WITH A REQUEST FOR A MAJOR EXPANSION OF A NON-CONFORMING SINGLE-FAMILY RESIDENCE. THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, applications for Variance 9-86 Permit 17-86 were duly filed Sneden, on May 9, 1986; and and Conditional Use by Keith and Mar1is WHEREAS, the applicants specifically requested permission to construct a major expansion/remodel of an existing, non-conforming single-family residence, which would include the use of a substandard, 34-foot long, tandem- style, two-stall garage which would encroach two feet into the five-foot rear yard setback, along with a second story balcony that would encroach six inches into the front yard setback; and WHEREAS, the subject property is located at the northeast corner of Landing Avenue and 15th Street (3g2 15th Street); and WHEREAS, the subject property is zoned RMD (Residential Medium Density) as are all surrounding properties, which also are developed with single family residences; and WHEREAS, the subject property and insufficient living area parking; and use are nonconforming due to and insufficient off-street WHEREAS, the' applicants' proposed improvements would add 1172 sq. ft., resulting in 1916 sq. ft. of living area, well in excess of the 95g sq. ft. minimum requirement; and WHEREAS, the applicants' proposed extension of the existing garage to create a 34-foot long, tandem-style, two- stall garage, would provide the required two off-street covered parking spaces for their two compact size automobiles; ~nd WHEREAS, alternative designs were explored and reviewed duly noticed at Planning Commission public hearings held on July 2, July 16 and August 6, 1986, and were found to be less practical and of poorer aesthetic quality than the applicants' proposal; and WHEREAS, the applicants' agreed to reduce the width of the deck off the proposed second floor family room by six inches, thus complying with the front yard setback standard for such decks; and WHEREAS, no opposing testimony was received at duly noticed public hearings held July, July 16 and August 6, 1986; and WHEREAS, the Planning Commission makes the following findings: 1. Approval of the requested Variance and Conditional Use Permit would not adversely affect the General Plan. . . RESOLUTION NUMBER Page 2 2. Due to the unique and special circumstances of the subject lot, including the fact that it is the only such reverse-corner lot containing such existing improvements on an unusually small (58'x58') site, the strict application of the development standards of the RMD Zone would deprive the subject property owner of the ability to construct a major remodel/expansion to their home, as other property owners in the same vicinity and zone may construct. 3. Due to the unique shape and size of this unusual reverse corner lot and the unique manner in which it is presently developed, approval of the requested Variance and Conditional Use Permit are based on the determination that the applicants' proposal is the best overall design approach from functional and aesthetic perspectives, to accomplish the maximum feasible development of this lot. It is also determined that the use of two compact sized parking spaces in a tandem style garage is not a special privilege for the subject property owner, since such a parking arrangement is part of a comprehensive design solution to a very unique parcel which is unlike any other residential lot in the City, and which therefore necessitates the use of such an unusual off-street parking arrangement. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission does hereby approve Variance 9-86 and Conditional Use Permit 17-86, subject to the following conditions: 1. That the development of the subject site shall conform to the site and floor plans submitted by the applicant and reviewed and approved by the Planning Commission on August 6, 1986, with the following exception: a. The deck off the second floor family room, facing 15th Street shall be reduced in width sufficiently to extend to a minimum of 18 feet from the front (15th Street) property line. 2. That approval of Variance 9-86 and CUP 17-86 shall one year following adoption of Resolution Number unless building permits have been granted improvements defined in condition number one, and active. expire , for the are still .. . .
