RESOLUTION NUMBER 1429
A RESOLUTION OF THE CITY OF SEAL BEACH PLANNING COMMISSION
APPROVING CONDITIONAL USE PERMIT 4-86, A REQUEST FOR AN ON-
SALE BEER AND WINE LICENSE TO BE USED IN CONJUNCTION WITH
THE RE-ESTABLISHMENT OF A WALK-IN/TAKE-OUT DELI/RESTAURANT
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
WHEREAS, on December 18, 1985, an application for Conditional
Use Permit 4-86 was submitted to the Department of
Development Services; and
WHEREAS, the subject property is described as Lots 11, 13, 15,
17, 19, 21, 23, 25 and 27 of Block 217 of Tract No. 10,
Seal Beach, California as recorded in Map Book 199,
Page 06 of the Orange County Recorder's Office; and
WHEREAS, the subject property is a rectangular shaped parcel of
land containing approximately 23,175 sq. ft. and is
located 150 ~ feet south of the centerline of Pacific
Coast Highway (321 Seal Beach Blvd); and
WHEREAS,
the subject

WHEREAS, on October 2, 1974, the Planning Commission approved
CUP 6-74, a request to permit the on-site sale of beer
and wine to be used in conjunction with a proposed
deli/restaurant, at 321 Seal Beach Blvd., issuing CUP
6-74 to Zada Tebbens; and
WHEREAS, on October 5, 1977, the Planning Commission approved
CUP 3-77, a request to transfer an on-site alcoholic
beverage license from Zada Tebbens to David Young to be
used at the same location; and
WHEREAS, in 1979, an alcoholic beverage license was transferred,
by the ABC, without Planning Commission approval, from
the previous operator at 321 Seal Beach Blvd. to Ramzi
Mansour for use at the same location; and
WHEREAS, in 1984, Ramzi Mansour lost his lease at the Shore Shop
Center; and
WHEREAS,
on February 10, 1986, the City
moratorium on the approval

WHEREAS, on June 9, 1986, the City Council approved Ordinance
Number 1224 repealing the moratorium on alcohol-related

WHEREAS, the applicant is specifically requesting CUP 4-86 to
permit an on-sale beer and wine license to complement
the menu of a walk-in/take-out deli/restaurant; and
WHEREAS, Stacy Picascia, Chief of Police, has researched
existing records and has no reservations regarding the
approval of this CUP by the Planning Commission; and
WHEREAS, on July 16, 1986, the Planning Commission held a duly
noticed public hearing on CUP 4-86, at which no
opposition to this request was received.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission does
hereby approve Conditional Use Permit 4-86 subject to the
following conditions:
1. That all alcoholic beverages sold in conjunction with the
restaurant operation be consumed entirely on the premises.
2. That all alcoholic beverages sold be served by hand over the
counter, within the premises.
3. That no coin-operated games be permitted on the premises.
4. That the applicant shall comply with all restrictions placed
on the license issued by the State Department of Alcoholic
Beverage Control.
5. That the CUP issued is non-transferable.
6.
