RESOLUTION NUMBER 1430
A RESOLUTION OF THE CITY OF SEAL BEACH PLANNING COMMISSION
APPROVING CONDITIONAL USE PERMIT 7-86, A REQUEST FOR AN
UPGRADING OF AN OFF-SALE BEER AND WINE LICENSE TO AN OFF-
SALE GENERAL LIQUOR LICENSE WITHIN 100 FEET OF A RESIDENTIAL
DISTRICT
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
WHEREAS,
on March 4, 1986, an application
Permit 7-86 was submitted to
Development Services; and
for Conditional Use
the Department of
WHEREAS, the subject property is described as Lot 161 of Tract
2591 as recorded in Map Book 83, Pages 14 to 18
inclusive of the Orange County Recorder's Office; and
WHEREAS,
the subject property is an irregularly
land containing approximately 7.49
located at the northwest corner of
Pacific Coast Highway (1111 East
Highway); and
shaped parcel of
acres, and is

Pacific Coast
WHEREAS, the subject property has approximately 650 feet of
frontage along Pacific Coast Highway, 826 feet along
Bolsa Avenue, and 605 feet along Balboa Drive; and
WHEREAS, the property contains the following retail-commercial
uses within the C-1 (Service Commercial) Zone:
Free Standing Restaurant
Car Wash
26 Stores in 1 Building
Supermarket and Drug Store
4,600 sq. ft.
4,800 sq. ft.
51,500 sq. ft.
44,200 sq. ft.
105,100 sq. ft.;and
WHEREAS, the surrounding land uses and zoning are as follows:
North and East - Single-family residences in the R.L.D.
(Residential Low Density) Zone; and
South - A former school in the P.L.U. (Public Land Use)
Zone, and a mixture of commercial uses in the C-2
(General Commercial) Zone; and
West - A gas station and savings and loan in the C-2
(General Commercial) Zone; and
WHEREAS, the subject property is within 100 feet of the R.L.D.
(Residential Low Density) Zone; and
WHEREAS, Section 28-1300(6)(a) of the Municipal Code requires a
Conditional Use Permit for establishments with off-sale
liquor located within 100 feet of a residentially zoned
property; and
WHEREAS, the applicant currently holds and unconditioned license
for off-sale beer and wine; and
WHEREAS, the applicant is specifically requesting CUP 7-86 to
permit an upgrading of the current off-sale beer and
wine license to an off-sale general liquor license; and

WHEREAS, on February 10, 1986, the City Council adopted a 45 day
moratorium on the approval of new Conditional Use
Permits pertaining to the sale of alcohol, and
subsequently extended the moratorium for 120 days on
April 14, 1986; and
WHEREAS, on June 9, 1986, the City Council approved Ordinance
Number 1224 repealing the moratorium on alcohol-related
Conditional Use Permits; and

WHEREAS, Stacy Picascia, Chief of Police, has researched
existing records and has no reservations regarding the
approval of this CUP by the Planning Commission; and
WHEREAS, on July 16, 1986, the Planning Commission held a duly
noticed public hearing on CUP 7-86, at which only one
negative comment was received.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission does
hereby approve Conditional Use Permit 7-86 subject to the
following conditions:
1. That no coin-operated games be permitted on the premises.
2 .
That the current hours of operation, 9:00 a.m.
Monday through Saturday, and 9:00 a.m. to 7:00
be maintained.
to 9;30 p.m.,
p.m. Sunday,
3. That ice be sold in bags no smaller than ten pounds.
4. That cups be sold in packages of 25 or more.
5. That the CUP issued is non-transferable.
6. That CUP 7-86 be reviewed by staff at the end of one year to
determine compliance with the conditions herein.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the
City of Seal Beach at a meeting thereof held on the __6~___ day
