HomeMy WebLinkAboutPC Res 1431 - 1986-08-16 t. . . , RESOLUTION NUMBER 1431 A RESOLUTION OF THE CITY OF SEAL BEACH PLANNING COMMISSION APPROVING CONDITIONAL USE PERMIT 10-86, A REQUEST FOR AN ON-SALE BEER AND WINE LICENSE TO BE USED IN CONJUNCTION WITH AN EXISTING FAST FOOD RESTAURANT, INCLUDING BOTH SIT- DOWN AND TAKE-OUT SERVICE THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, on April 1, 1986, an application Permit 10-86 was submitted to Development Services; and for Conditional Use the Department of WHEREAS, the subject property is a rectangular containing approximately 4150 square located approximately 575 feet south of of Bradbury Road (12161 Seal Beach Rossmoor Business Center; and parcel of land feet and is the centerline Blvd.) in the WHEREAS, the subject property has approximately 40 feet of frontage on Seal Beach Boulevard; and WHEREAS, the subject property contains a commercial building of approximately 1350 square feet; and WHEREAS, the surrounding land uses and zoning are as follows: North and South - A mixture of general commercial uses within the Rossmoor Center in the C-2 (General Commercial) Zone of the City of Seal Beach, and single family homes in the community of Rossmoor in the unincorporated territory of the County of Orange. West Multi-family residences in the City of Seal Beach and the Community of Rossmoor; and WHEREAS, the applicant is specifically requesting obtain a license for on-sale beer complement a Chicago-style fast food restaurant including both sit-down service; and CUP 10-86 to and wine to menu in a and take-out WHEREAS, on February 10, 1986, the City Council adopted a 45-day moratorium on the approval of new Conditional Use Permits pertaining to the sale of alconol, and subsequently extended the moratorium for 120 days on April 14, 1986; and WHEREAS, on June 9, 1986, the City Council approved Ordinance Number 1224 repealing the moratorium on alcohol-related Conditional Use Permits; and WHEREAS, Stacy Picascia, Chief of Police, has researched existing records and has no reservations regarding the approval of this CUP by the Planning Commission; and WHEREAS, on July 16, 1986, the Planning Commission held a duly noticed public hearing on CUP 10-86, at which no opposing testimony was received. .. ... . . . . "j I' ., t' I ,..- Resolution #1431 Page 2 NOW, THEREFORE, BE IT RESOLVED that the Planning Commission does hereby approve Conditional Use Permit 10-86 subject to the following conditions: 1. That all alcoholic beverages sold in conjunction with the restaurant operation be consumed entirely on the premises. 2. That all alcoholic beverages sold be served by hand over the counter, within the premises. 3. That no coin-operated games be permitted on the premises. 4. That the applicant shall comply with all restrictions placed on the license issued by the State Department of Alcoholic Beverage Control. 5. That the CUP issued is non-transferable. 6.
