RESOLUTION NUMBER 1439
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF SEAL BEACH APPROVING CONDITIONAL
USE PERMIT 14-86, A REQUEST TO PERMIT ON-SALE
BEER AND WINE IN CONJUNCTION WITH A NEW
RESTAURANT (901 OCEAN AVENUE)
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
WHEREAS, on September 9, 1986 Jack Haley, 404 Ocean Avenue, Seal
Beach, submitted an application for Conditional Use
Permit 14-86 to the Department of Development Services;
and
WHEREAS, the applicant is requesting to establish a new
restaurant with on-sale beer and wine on a site
previously occupied by the same use; and
WHEREAS, the subject property contains approximately 5,500
square feet, and is located at the northeast corner of
Ocean Avenue and Main Street; and
WHEREAS,
the subject property has approximately
frontage on Ocean Avenue and 110 feet of
Main Street; and
50 feet of
frontage on
WHEREAS, the subject property contains a restaurant of 1,821
square feet with three (3) compact parking spaces and
seven (1) standard parking spaces provided on site; and
WHEREAS, the surrounding land uses and zoning are as follows:
North and West a mixture of offices, commercial
retail, commercial services and multifamily residential
uses in the C-l (Service Commercial) zone.
East - Commercial retail businesses in the C-1 (Service
Commercial) zone.
South - Eisenhower Park, the Municipal Pier, and beach
located in the PLU (Public Land Use) Zone; and
WHEREAS, Main Street and Ocean Avenue are primary streets
developed to their ultimate master planned width of 80
feet; and
WHEREAS, the new restaurant proposed for 901 Ocean Avenue
represents no intensification of the prior restaurant
use. Hence, no additional parking, beyond
participation at current levels in the in-lieu parking
program, is required, nor is any further variance
application required; and
WHEREAS, the specifics of the restaurant operation are as
follows:

B. The proposed hours of operation are 6:30 a.m to
1:30 a.m. Monday through Sunday. The take-out
window is expected to be open between 10:00 a.m
and 5:00 p.m. May through September 10.
C. The proposed method of alcoholic beverage service
is described as:
1. On sale beer and wine
2. Sit down restaurant with food and
alcoholic beverage servers who check all
i.d.s (must be over 21 years) before
serving the public.
3. Restaurant will have a 13 foot counter
with 7 stools (combination breakfast-
bar top.);and
WHEREAS, on September 19, 1984 the Planning Commission adopted
Resolution #1343 approving a restaurant with on-sale
beer and wine at 901 Ocean Avenue. This CUP was
approved for Tom and Vicki Winch, and was
nontransferable.
WHEREAS, historically, the subject property has been used as a
restaurant catering to the beach-going public with
take-out facilities; and
WHEREAS, Stacy Picascia, Chief of Police, has reviewed existing
records and has no reservations about permitting this
operation to commence; and
WHEREAS, the request is compatible with the surrounding land
uses, the community in general, and the General Plan;
and
WHEREAS, a duly noticed public hearing was held on October 15,
1986
NOW THEREFORE BE IT RESOLVED that the Planning Commission of the
City of Seal Beach does hereby approve Conditional Use Permit 14-
86 subject to the following conditions:

3. No coin operated games shall be permitted on the premises.
4. The applicant shall comply with all restrictions placed on
the license issued by the State Department of Alcoholic
Beverage Control.
5. The CUP issued shall be nontransferable.
6. No alcoholic beverage advertising or display devices shall
be located in the window areas, or outside the restaurant.
7. A detailed landscaping and irrigation plan which provides
landscaping of 10% of the site area shall be submitted to
the Director of Development Services.
8. Eight on-site parking spaces shall be striped and maintained
for the use of restaurant employees and patrons as per the
approved site plan.

9. The applicant/property owner shall agree to participate in
such in-lieu parking program as has been or shall be
established by the City Council to the amount equal to
eleven spaces. Any changes to the total parking requirement
for the site shall cause the modification of the rate of
participation in the in-lieu program, subject to Planning
Commission approval.
10. Hours of operation shall be from 6:30 a.m. to 1:00 a.m.
11. The term of this permit shall be twelve (12) months, after
which time the Planning Commission may extend the permit
indefinitely provided that all conditions of approval have
been satisfied and no significant police problems have
occurred.
12. The applicant shall provide a complete final set of plans
depicting the improvements at 901 Ocean Avenue to the
satisfaction of the Director of Development Services.
PASSED, APPROVED AND ADOPTED by the Planning Commission of the
City of Seal Beach at a meeting thereof held on the 5th day of
November, 1986 by the following vote:
